In Case You Missed It - The Brevard County Commissioners unanimously voted to deny the appeal of Merritt Bidco to build a 222-unit apartment complex around the old Wuesthoff Medical Center on N. Courtenay Parkway. I missed the meeting (I was up North visiting family) so I watched it after the fact on YouTube. Congratulations to everyone coming together as a community.

The proposed Courtenay/Pioneer 222 Apartments is back on the County Commissioners’ Agenda for later this month.

This zoning is not on North Merritt Island. But we wanted to share it here because it is located where it could greatly affect life on the island.

The developer is pursuing an administrative appeal to try and overturn the county's decision and force their high-density apartment complex. While they have the legal right to file an appeal process, they do not have the legal grounds to get what they are asking for. They are trying to claim the Agricultural (AU) land should be treated as commercial so they can use the Live Local Act.

The Law is Explicit: The Live Local Act excludes AU agricultural land.

The Claims are Legally Flawed: The developer is trying to use a 1983 permit for a hospital that was never built to claim the land is commercial. County staff confirmed in their June 23, 2026 report that this permit is completely abandoned, nonconforming, and legally invalid for this request.

New 2026 State Law Protects Us: Florida's brand-new HB 1389 explicitly clarifies that agricultural activities and sales (like farmers' markets) do not make a zone commercial for Live Local eligibility.

Construction has started on the Barge Canal Bridge. Things may have seemed quiet last week, but we checked in with the FDOT outreach specialist who said that work had started on bridge’s internal systems. The contact offered to provide frequent updates on the project. We will publish them here and in our monthly newsletter as they come in.

Zoning Update: The Brevard County Commissioners voted to deny 26Z00007. The property’s address is 6455 North Tropical Trail, at the intersection with and south of McGruder Rd. Turtle Mound Ventures (Kim Rezenka) requested to rezone this 28.37 acres parcel from GML(I) (Government Managed Lands - Institutional) and TR-1 (Single-family Mobile Home) to RVP (Recreational Vehicle Park). After the vote denying the request, Commissioner Goodson (D2) asked the county to prepare a finding of facts documenting the details of the request and how the board came to the decision to deny the request.

ZONING UPDATE: The Brevard County Commissioners voted to approve request 26Z00006 removing the old binding development plan (BDP) and adding a new BDP which would allow outdoor storage and heavy equipment repair. This property is located on the east side of N. Courtenay Parkway, approximately 431 feet north of East Crisafulli Road.
