NEWS RELEASE: Today, the Hidalgo County Commissioners Court adopted an order prohibiting roadside sales of non-livestock animals within the unincorporated areas of the county. The order becomes effective immediately.
The order bans the roadside sale of non-livestock animals along highways, roads and parking lots in unincorporated areas of the county. It also prohibits setting up any structure for the purpose of selling animals.
“This order reflects our responsibility to safeguard both people and animals,” said Hidalgo County Judge Richard F. Cortez. “Roadside sales create dangerous conditions for drivers and vendors, and contributes to problems with stray and abandoned pets. By enforcing this measure, we are prioritizing public safety, animal welfare, and the well-being of our community.”
Those found in violation of the order may face Class C misdemeanor charges, and every day of noncompliance counts as a separate offense. The county is also authorized to remove any structures used in violation of the order. County law enforcement and code officials will begin enforcing the order immediately.
The 89th Legislature recently amended and passed House Bill 2731, and the bill was signed into law on September 1, 2025, which gave the county authority to enact this order.
