Dear Marple Residents and Friends,
If you have recently passed by the Corner of Sproul and Cedar Grove Roads, no doubt you have noticed the apparent construction activity that Exelon/PECO and their sub-contractors have begun. THIS DOES NOT MEAN THAT OUR CASE HAS BEEN LOST. In fact, the case is still moving slowly towards another decision at the Pennsylvania Commonwealth Court, and briefing will be complete sometime during this summer.
Paragraph 4, on page 4 of the attached document, seems to suggest that there is an agreement between Marple Township and Exelon/PECO which seems to state that construction cannot begin until after the Commonwealth Court has ruled in PECO's favor. In that Agreement PECO also agrees to tear out all pipes if it loses. Despite this Agreement, Exelon/PECO has decided to begin construction on the building. This can only be construed as Exelon/PECO beginning construction at its own risk. Based on our reading of the Agreement, if we receive a final ruling in our favor, this Agreement should require Exelon/PECO to remove everything it has built or is building, including the existing "lateral line" that has been sticking out of the ground for a few years.
