Lamar Advertising, which about a hundred billboards in Fayette County, Kentucky as well as some in Dane County, Wisconsin, was on the losing end of a federal court decision: Lexington's regulation of billboards does not interfere with the billboard company's first amendment rights:

This is good news for Madison, Fitchburg, and other municipalities that have ordinances regulating billboards.

Lamar Advertising had challenged the city’s near total ban on electronic billboards in federal court, alleging its First Amendment rights were violated, among other arguments.

Austin, Texas, is a leader in the fight against billboard blight. Austin just scored a big win in court against outdoor advertiser Lamar Advertising, one of the players in Dane County.

The Austin, Texas, court decision we previously reported last April 21 has come home to roost in Madison. A 3-judge panel of the federal 7th Circuit Court of Appeals has ruled that Adams Outdoor Advertising cannot sue the city over allegations that its sign code is unconstitutional, relying on the Austin decision. Read about it in the January 12, 2023 Wisconsin State Journal!

The U.S. Court of Appeals, 7th Circuit, rejected a lawsuit by Adams Outdoor Advertising that claimed the city sign ordinance is unconstitutional.

Lamar Advertising, a minor player in the Madison market, was dealt a blow in case that could have wide-spread implications. The U.S. Supreme Court, in a 6-3 ruling, just determined that Austin, Texas regulations of "off-premises" signs were not unconstitutional content-based restrictions on free speech, even though the sign must be read to determine whether it was advertising for an on- or off-premises business. This bodes well for local Madison and Fitchburg regulation of off-premises signs, which basically ban new billboards.

The U.S. Supreme Court, on a vote of 5-4, has upheld the City of Austin restrictions on billboards and other signs.

Lamar Advertising is suing a Kentucky county to overturn the county's sign regulations on "free speech" grounds. Lamar also has billboards in Dane County.
It must be somewhat draining to work in an industry where the business model involves constantly suing governments.

Lamar Advertising argues that prohibiting the installation of electronic billboards violates free speech.

Our Madison area local billboard company continues its national business model of suing municipalities for the ability to pollute the visual environment. This time it's Mount Pleasant, South Carolina. Is this the kind of corporate citizen we want in Dane County?

Adams Outdoor Advertising is suing Mount Pleasant in federal court over the town's billboard regulations.

A federal judge has dismissed the latest lawsuit by Adams Outdoor Advertising to overturn Madison's sign code. That's good news for Fitchburg, Dane County, and everyone who values beauty outdoors! Citizens for a Scenic Wisconsin, Inc.

In a 51-page decision, U.S. District Court Judge James D. Peterson said Madison city government is entitled to decide "Whether the Capitol Square should look like Times Square."
