“Neither of these things [the DOJ memo and notice] has the force of law, but they appear designed to undermine the rights of people with disabilities to live in their own homes and communities. The disability community will continue to fight these attacks on their hard won rights.”

Yesterday, the DOJ moved to sow further fear and confusion by issuing a notice that looks to dismantle decades of precedent and law.

The ADA is still law.
Olmstead is still law.

Recent disability rights advocacy groups have raised concerns about a U.S. Department of Justice position related to enforcement of the Supreme Court's Olmstead v. L.C. decision. The 1999 Olmstead ruling held that unnecessary institutionalization of people with disabilities can constitute discrimination under the Americans with Disabilities Act and supports access to services in community-based settings when appropriate.

Advocates are expressing concern that changes in federal enforcement could affect protections related to home and community-based services. They are encouraging individuals to learn more about the issue, contact elected officials if they wish to share their views, and stay informed about policies that may impact people with disabilities.
