As you know, the County has appealed Judge Spahr's decision to the Indiana Court of Appeals. Personally, the chances of that decision being overturned are not high, but it can occur. Appeals are very tedious and time consuming work, and expensive. In addition, the Plaintiffs have requested research as to an injunction against the construction and bringing the construction to a halt while the appeal is pending over the next 4 to 6 months. The first body blow has been scored by the citizens, and now the Plaintiffs want to continue with the momentum. Doing so requires some additional legal assistance and Jim and I are maxed out at the present time. That being said, if you are on this page, and you are serious about a) stopping WSP or b) getting the best outcome for the citizens if WSP comes on line, on behalf of the Plaintiffs, the CCCC, Jim, and myself, I am asking that each of you get with Susan and donate $5, $10, or whatever else. Just the sheer size of this group can quickly, through very small donations, raise a large amount. You have waited over a year for the tide in all of this to turn......do not let the tide go back out to sea due to lack of funding.

Cass County residents living close to WSP will get another day in court. Judge Timothy P. Spahr has ruled that the residents do not have to post a bond before presenting their Open Door case against Cass County.

Residents seeking to protect their health and value of their property sued Cass County government, arguing that government’s decisions made behind closed doors denied them the chance to press for stricter pollution monitoring and controls.

The County asked the Court to make the residents post millions of dollars as a bond before the Open Door part of the case could be heard. The Court has now denied the County’s request. This gives the residents the right to argue that the County created a secret “WSP Incentive Committee” that triggered the County Council’s vote in favor of $17 million of TIF bonds and $70 million in conduit bonds, all for the benefit of WSP.

Referring to the law that the County tried to use, Judge Spahr wrote that it is important to ensure that that law “is not applied to cases in an overbroad fashion so as to slam the courthouse door on cases that do have merit.”

This decision by Judge Spahr is the first in a two-part case. The second part is about the Open Door Law, which requires that citizens can observe their government making decisions. The residents challenge the approval of the County’s bonds for WSP, because that decision was made behind closed doors. In his decision, Judge Spahr took special note of some of the arguments that the residents made, particularly lead’s effect on children and that dioxin is a known carcinogen.

Jim Brugh of Logansport and John Schwarz of Royal Centre are representing the residents. “The Coalition and its supporters have cause to celebrate,” said Brugh.
