Against All Oddz Animal Alliance Makes Grim Discovery on 3rd Street.
ROCHESTER, NY – On March 18, 2026, Against All Oddz Animal Alliance directors Eileen Marutiak and Matthew Albert went to 161 3rd Street for the purpose of conducting an educational video on animal welfare law.
Specifically, Mr. Albert conducted a live feed explaining §373(2) of New York’s Agriculture and Markets Law (AML) to the public. This law allows law enforcement to obtain a search warrant for animals that have been left alone or kept in unhealthy or unsanitary conditions for more than 12 hours.
The purpose of the video was to question why Lollypop Farm has allowed these dogs to languish in such a deplorable state for so long. Advocates have been raising concerns about the conditions at 3rd Street since dogs were found frozen in a backyard during subzero temperatures in January and February of 2026. Neighbors have also been reporting deplorable conditions and dogs being left outside continuously dating back to at least October of 2025.
Given the reports from neighbors, as well as the lack of any tracks in the snow, it is clear that these dogs have been left unattended for extended periods of time.
When Mr. Albert and Ms. Marutiak approached the residence to speak with the owner, Bryan Wyatt, and offer assistance for him and his animals, they observed dogs in clear distress. This included at least one dog with wounds and scarring in various stages of healing across his body.
It should be noted that Ms. Marutiak had been sending a series of emails to Alice Calabrese at Lollypop Farm since early March expressing the urgency of the situation based on repeated tips from neighbors and requesting intervention well before this date. The neighbors were willing to cooperate with law enforcement.
“These dogs did not just suffer overnight,” said Marutiak. “This was prolonged, visible neglect that the community has been reporting for months. The law is clear. The warning signs were clear. If Lollypop had intervened when they were first made aware of the situation, this outcome could have been prevented.”
Later that afternoon, after Mr. Wyatt reportedly contacted law enforcement to file a trespass complaint regarding Mr. Albert and Ms. Marutiak approaching the residence, law enforcement entered the home. Upon entry, authorities discovered a deceased dog, in addition to at least one other dog who was severely wounded.
Despite these findings, Mr. Wyatt was not charged.
Thousands of animal advocates have expressed concern over what they describe as a tepid and impotent response to animal cruelty by both Lollypop Farm and the Rochester Police Department. Advocates state that the death of the dog on Third Street is a direct result of law enforcement’s failure to protect animals they take oaths to protect.
“We received and reviewed photographs of an original group of dogs at Third Street that have since disappeared,” said Albert. “This is simply the next group of dogs suffering at the hands of the owner, Bryan Wyatt, and at the hands of the Rochester Police Department and Lollypop Farms, who are enabling Mr. Wyatt to torture these animals. The blood is on their hands.”
Against All Oddz Animal Alliance remains committed to improving the state of animal welfare in the City of Rochester. The organization is calling on City Council to work collaboratively to enact stronger enforcement mechanisms, mandatory training, and policy changes for the City and its police department, with the goal of meaningfully improving animal welfare outcomes.
Against All Oddz Animal Alliance has submitted ideas and laws to the City Council, who have so far ignored the issue in its entirety.
