🚨 **PENNSYLVANIA ONLINE RAFFLE LEGISLATION UPDATE — THURSDAY, OCTOBER 15**

The Pennsylvania House is scheduled to return to session today, and we have two important bills to watch!

📌 **SB398 — THIRD CONSIDERATION**

SB398 is scheduled for third consideration and a vote on final passage in the House today. Based on the voting record so far, we have reason to be optimistic that it will pass.

If successfully passed, SB398 will be referred back to the Senate for concurrence on the House amendments. That would be another important step forward for our effort to secure legal online raffles for eligible nonprofit organizations.

📌 **SB416 — OUR NEXT CRITICAL STEP**

What is NOT on today's published House Calendar is SB416, our primary focus, to be taken off the table.

Could that happen today? **YES. But it is not certain.**

For SB416 to move forward, it needs to be taken off the table and referred to the **House Appropriations Committee** for review and a vote. That is the next critical step in getting this legislation moving again.

🚨 TUESDAY LEGISLATIVE UPDATE — HERE’S WHERE WE STAND

We know there has been a lot happening in Harrisburg, so here is an update on what we know as of the end of today’s House session.

For clarification on what each bill does, please see our previous post. It is important that everyone understands that SB398 and SB416 address the online raffle issue facing eligible nonprofit organizations — they have NOTHING to do with Skill Games.

🟢 SB398 — MOVING FORWARD

Yesterday, SB398 received its second consideration on the House floor.

Two amendments were adopted, both by nearly unanimous votes.

Unfortunately, an amendment offered by Rep. Kate Klunk of York County did NOT pass.

Rep. Klunk’s amendment would have expanded the legislation to allow ALL eligible nonprofit organizations to conduct online raffles — rather than limiting the authorization to fire companies.

While we are disappointed that this amendment was defeated, we appreciate Rep. Klunk for making the effort to address the broader nonprofit community.

SB398 continued its journey today and was referred back from the House Appropriations Committee unanimously.

That is significant progress.

🟡 SB416 — FINALLY MOVING AGAIN

SB416 has been stagnant since last week, when it left the House Gaming Oversight Committee.

Today, toward the end of the House session, SB416 was referred to the House Appropriations Committee.

We are hopeful that the Appropriations Committee will take up SB416 tomorrow, although the committee schedule has not yet been posted.

If it moves through Appropriations, the next steps are:

➡️ House floor — final consideration
➡️ Return to the Senate for concurrence
➡️ Final action

Depending on tomorrow's House floor schedule, it is technically possible that all of this could happen tomorrow — but realistically, that is unlikely.

📢 WHAT HAPPENS NEXT?

For now, we are waiting.

We do NOT want everyone making unnecessary calls or sending unnecessary emails until we know exactly what is needed.

We will continue watching Harrisburg closely and will let you know as soon as we know whether additional calls or emails to House and Senate Leadership are necessary.

❤️ OVERALL, WE ARE PLEASED — BUT DISAPPOINTED

Overall, we are pleased with the progress made this week.

SB398 is moving. SB416 is moving again.

That is good news.

But we are also disheartened that Rep. Klunk’s amendment was voted down on the House floor.

The nonprofit community is much larger than just fire companies, and we recognize and appreciate the effort to address the needs of ALL eligible nonprofits across Pennsylvania.

For now, we remain focused on the goal:

GET SB398 AND SB416 PASSED AND BACK TO THE SENATE.

With almost 150,000 views on our post from yesterday, it is clear that there is some confusion about exactly WHICH bills passed through the House Gaming Oversight Committee.

So let's make this VERY clear:

🚨 NEITHER SB 398 NOR SB 416 HAS ANYTHING TO DO WITH SKILL GAMES. 🚨

NOTHING.

The fact that these bills were considered by the House Gaming Oversight Committee does NOT make them Skill Games legislation.

These are SMALL GAMES OF CHANCE / RAFFLE bills designed to allow Pennsylvania's eligible organizations — and, in the case of SB 398, specifically fire companies — to use modern technology for fundraising activities they are already authorized to conduct.

🎟️ SB 398 — ONLINE RAFFLES FOR FIRE COMPANIES

SB 398 is about ONLINE RAFFLES by licensed fire companies.

That's it.

The current House-amended version specifically authorizes a fire company holding a valid Small Games of Chance license to conduct raffles over the Internet, subject to the requirements contained in the legislation.

💳 SB 416 — ELECTRONIC PAYMENT FOR RAFFLE TICKETS

SB 416 is about PAYMENT.

It amends Pennsylvania's Small Games of Chance law to provide for electronic payment methods for games of chance. The bill is commonly described as addressing mobile payment services for Small Games of Chance.

🤔 SO WHAT ARE WE ACTUALLY TALKING ABOUT?

A RAFFLE.

The raffle doesn't magically become something different because somebody purchases the ticket online.

🎟️ The raffle is the same.
🎟️ The ticket is the same.
🎟️ The prize is the same.
🎟️ The drawing is the same.
🎟️ The odds are the same.

The difference is HOW THE TICKET IS PURCHASED.

Instead of requiring someone to physically walk into a fire station, nonprofit, social club or other eligible organization and hand someone cash or another permitted form of payment for a raffle ticket, these bills allow the organization to utilize modern electronic technology to reach a broader audience.

SELLING A RAFFLE TICKET IN PERSON = A RAFFLE.

SELLING THAT RAFFLE TICKET THROUGH AN AUTHORIZED ONLINE/ELECTRONIC PROCESS = STILL A RAFFLE.

📱 THE TECHNOLOGY DOES NOT CHANGE THE NATURE OF THE RAFFLE.

And let's be absolutely clear:

🚫 THIS IS NOT SKILL GAMES LEGISLATION.

We are **NOT** trying to insert Skill Games into these bills.

We are **NOT** asking for some new form of gambling.

We are advocating for Pennsylvania nonprofits and volunteer fire companies to be able to use 21st-century technology to conduct and collect payment for traditional fundraising raffles.

The Pennsylvania General Assembly's own bill descriptions identify SB 398 as legislation concerning online raffles by fire companies and SB 416 as legislation concerning payment under the Small Games of Chance Act.

🚒 WHY DOES THIS MATTER?

Volunteer fire companies are being asked to do more with less.

Fundraising is critical.

And the way people conduct financial transactions has changed dramatically.

If someone can order dinner, buy concert tickets, pay a bill, purchase merchandise and conduct countless other legitimate transactions from their phone, why should a nonprofit raffle ticket be forced into a 20th-century purchasing model?

We are simply asking Pennsylvania law to recognize the technology people already use every day.

Traditional raffle.

Modern technology.

Same fundraising purpose.

NO SKILL GAMES IN THESE BILLS
