New York’s legislative session may be over, but the fight to close the voluntary intoxication loophole isn’t.

Under current New York law, a person’s voluntary intoxication can prevent prosecutors from pursuing certain sexual assault charges when the person was unable to consent because of their level of intoxication. A.101 would close this dangerous gap in the law.

Governor Hochul has the power to call lawmakers back to Albany for a special session. We’re calling on Governor Hochul and Speaker Heastie to bring A.101 to a vote.

Voluntarily drinking is not consent to sexual activity. Period.

We need your help. Another bill with a long name, but ASPEN relies on funding from VOCA to provide direct services. Please contact your Senators, Senator Steve Daines and Senator Tim Sheehy in Montana, and tell them to pass CVFSA, the Crime Victims Fund Stabilization Act. It already passed the house by a large majority. We're almost there. Tomorrow is a day of action in support of this critical bill. Please lend your voice as soon as you can to support survivors. 💜
