We've shared this before, but it’s now official—homes are being sold in the new development directly behind the Highland Paving Asphalt Plant.
Important reminder: If you buy directly from the builder, they are not legally required to disclose that you’ll have an asphalt plant in your backyard.

Licensed realtors, on the other hand, are legally obligated to provide a disclosure form that includes any environmental or industrial odors that could impact your health and quality of life.

D.R. Horton has begun selling homes in its newest subdivision off Matthews Road in Lillington, with prices starting in the upper $300s.

As we've pointed out before, this development sits directly behind the Highland Paving Asphalt Plant and the Crete Solutions Plant.
Residents nearby have reported that asphalt fumes from overnight operations can be strong enough to be smelled indoors. Anyone who drives past the plant on Hwy 401 early in the morning can confirm how noticeable the smell is. We also have air quality monitors in the area that have read high levels of pollution during plant operations.

Important note: Builders are not held to the same disclosure requirements as licensed realtors. Realtors are legally obligated to inform potential buyers of nearby industrial activity, environmental concerns, and odors that could affect the property.

If there is a licensed agent on site, get your own! Builder representatives are often licensed real estate agents; however, this is not always the case. Some builder representatives may be employees of the builder without a real estate license. Licensed agents are bound by the North Carolina Real Estate Commission's rules, which require them to disclose all material facts about a property, including environmental concerns or nuisances that could affect a buyer's decision.
