SB 4 was first introduced in 2017, and has gone through various amendments throughout the years. This year it has been put into effect which will have a detrimental impact to our marginalized communities. What does this mean for us?
The key provisions of this bill are mandatory compliance with ICE detainer requests, prevents “sanctuary cities”, and ,recently, allows for local law enforcement arrest those suspected of entering the state without authorization. This will directly result in unjust arrests from racial profiling simply for being brown and speaking Spanish.
What can we do?
KNOW YOUR RIGHTS! Remember your 4th, 5th, and 6th, amendments.
4th You reserve the right to protection from unjust searches and seizures. DO NOT OPEN YOUR DOOR. “I do not give you the right to enter my home/search my car without a judicial warrant.”
5th You have the right to remain silent. “I’m invoking my right to remain silent under my 5th amendment right”
6th You have the right to refuse to sign documents without a lawyer present. “I want to talk to a lawyer before signing any documents”
