Dear Friends:

As you know, we have been following two bills with great interest: HB 1277 and SB 275. Both are on second reading today in the General Assembly. This could be the last time these bills are eligible for amendment this session. The General Assembly is scheduled to adjourn on Friday. The Senate goes into session at 1:30 p.m. today. The House went into session at 11:00 a.m. today.

HB 1277 remains a bad bill. You should ask the members of the Senate to vote NO on HB1277. Call 317.232.9400 or 800.382.9467 to leave messages for members of the Senate. Leave messages for as many Senators as possible. Please call as soon as possible.

Nine amendments have been filed to amend HB 1277. Only one of those amendments, Amendment 2 by Sen. JD Ford, addresses the problems that make HB 1277 a bad bill. The Ford amendment would convert the legislation into a study committee to thoroughly study and review the issues in the legislation. Citizens could participate in the study committee process. It is highly unlikely that Amendment 2 will be adopted since Sen. Ford is one of only ten Democrats in the Senate. However, voicing your support for Sen. Ford's amendment is still a good idea.

Remember, HB 1277 will take client service slots from the Medicaid waiver for home and community based services at a time when there are waiting lists for those service slots, and it would limit the dollars that could be spent on home and community based services for an individual. The bill is biased toward institutional providers. It remains a bad bill.

I will send you a second alert a bit later regarding SB 275. As you know provisions that would have the effect of denying Medicaid support for medical expenses for low income individuals were removed from SB 275 last week. However, we are still reviewing the amendments that have been filed in the House for consideration on second reading regarding SB 275. We will complete this review as soon as we can.
