Apparently deeds don’t matter anymore. At least not according to this HOA.

There is a recorded deed on file in Jackson County showing ownership. A real one. The kind people rely on when they buy property.
But in court filings the Wallstreet Tower HOA and management company FirstService Residential have decided an individual is “no longer a unit owner.” despite holding title and deed.

Not a typo. Not a misunderstanding. That’s their actual position. And they haven't stopped there.

They are asking a court to declare that this deeded owner is not entitled access to the condo building or amenities.

When they show up? They call it trespassing.

Their working theory seems to be:
Deeds don’t matter
Ownership is optional
Access is whatever the HOA feels like that day

Instead of correcting course, they’ve doubled down—filing counterclaims and spending association resources to defend this position in court.

All paid for by the very owners they’re claiming may or may not actually be “owners.”

If they can redefine ownership here, they can do it to anyone.

HOA Fight Club? 🥊🥷 🚓👮

Board members attacked and blocked entry to a residents unit with family inside in 2024. KCPD issued assault related charges after the incident. The suspects appeared intoxicated, carrying beers. The police report details this "has been an ongoing issue" with the HOA board who have allegedly "been trying to get [the victim] evicted". First Service Residential, the property manager, has refused to fine the board members for their misconduct.

A former board member selling a unit in the building previously stated:

“𝘐 𝘩𝘢𝘥 𝘴𝘰𝘮𝘦𝘵𝘩𝘪𝘯𝘨 𝘵𝘩𝘢𝘵 𝘐 𝘥𝘪𝘥𝘯’𝘵 𝘭𝘪𝘬𝘦 𝘢𝘣𝘰𝘶𝘵 𝘮𝘺 𝘭𝘢𝘴𝘵 𝘩𝘰𝘶𝘴𝘦, 𝘴𝘰 𝘐 𝘸𝘢𝘴 𝘢𝘯 𝘢𝘥𝘶𝘭𝘵 𝘢𝘯𝘥 𝘴𝘰𝘭𝘥 𝘪𝘵 𝘢𝘯𝘥 𝘮𝘰𝘷𝘦𝘥.”

That same unit ( #1202) has now been on the market for 270+ days.

Prospective buyers should consider that perspective when evaluating condominium ownership. Views on how owners should respond to problems—whether by working through them or choosing to sell—can differ within any shared-ownership community.

Privacy Alert - Drone flights!

On November 19th, an HOA sponsored drone flew around our building as early as 8 AM. Notice was sent less than 24 hours prior, at 5:39 p.m. on November 18th. This short notice gave residents little time to protect private areas visible through windows.

Seven months ago a condo owner was forcibly removed from an HOA meeting, without cause, by police after a board member called 911 feigning emergency. Predictably, the owner who was wrongfully removed and harassed is now suing the association. From record requests and court filings we've learned the following:

1. Several defamatory assertions have been made claiming the person removed, Dustin Kraxner, is not an owner. That is false. He irrefutably owns a condo at Wallstreet Tower.

2. Dustin's ex-wife, Rachel Kuehn, is the HOA Board Secretary. She is also who called 911 requesting police assistance.

3. The HOA and building management has blocked Dustin's access to the condominium.

4. Rachel was personally instructed by a court to stop blocking and harassing Dustin. Unfortunately, she has refused to do so.

5. Dustin repeatedly called for a vote for removal of the board, as the bylaws allow. The board has refused.

Bottom line: The HOA board and management continue to put every member of the association in this untenable position. These bad actors aren't just inviting liability, they are willfully creating it.

This month's board meeting was postponed due to "scheduling conflicts" - by the same people who scheduled it. 🙄 August's meeting was also "cancelled", however the board apparently met in secret as they passed a lease addendum that same day! Without homeowner notice, discussion, or a vote. What surprises are we in for this time?

The new addendum allows the HOA to:
-Automatically be your attorney in fact (POA)
-Terminate your lease agreements
-Sue on your behalf, without your permission.
-Bill you attorneys fees for doing so.
-Seize rental income directly from your tenant to pay these bills.
-Suspend owners rights or privileges to the common spaces.
-Suspend owners voting rights.

Way to destroy property values and limit resale opportunities.

The board also increased Directors & Officers (D&O) insurance coverage by 900% or 10x from $100K to $1,000,000 in September - despite claiming at the last board meeting that the new policy was "as it was" and "the same". Why does the board continue to lie? How much wrongdoing has been done?

Property Manager Kathleen Doherty has been fired/let go/resigned. But, why is FirstService Residential still the property management company and why hasn't the board resigned? How much more money are they going to cost the community with their shenanigans?
