Apparently deeds don’t matter anymore. At least not according to this HOA.
There is a recorded deed on file in Jackson County showing ownership. A real one. The kind people rely on when they buy property.
But in court filings the Wallstreet Tower HOA and management company FirstService Residential have decided an individual is “no longer a unit owner.” despite holding title and deed.
Not a typo. Not a misunderstanding. That’s their actual position. And they haven't stopped there.
They are asking a court to declare that this deeded owner is not entitled access to the condo building or amenities.
When they show up? They call it trespassing.
Their working theory seems to be:
Deeds don’t matter
Ownership is optional
Access is whatever the HOA feels like that day
Instead of correcting course, they’ve doubled down—filing counterclaims and spending association resources to defend this position in court.
All paid for by the very owners they’re claiming may or may not actually be “owners.”
If they can redefine ownership here, they can do it to anyone.
