Why is our pool closed and others are open?
Some associations are spending the money to pay monitors, have extra janitorial services at a cost plus the supplies needed per the Order, and pay extra fees to have a “scheduler” for the oversight of monitors. These costs are running $600 a week at some properties. Botanica is a larger, family friendly community with more usage that other pools that are opening. For example, Jupiter Dunes has seasonal owners who have recently left to go to their primary homes so the Board can open from 10 – 5 each day with monitors and paying extra for janitors to come clean restrooms, water coolers, and all furniture. We have tracked their pools to 7 people at each one during our spot checks. Botanica population will be turned away once the number exceeds the social distancing guidelines of 6’ apart.
Who is telling us that there is liability on the Board of Directors if they vote to open the pool?
Because we are in a global pandemic with strict guidelines by the County, State, and CDC, the attorney’s and insurance professionals are very cautious for our volunteer Board members to take on the liability. This means if someone gets COVID 19 and could track back to the pool, any lawyer could bring suit against the association and the Board of Directors personally. Directors and Officers Insurance will not cover this claim. Again, Botanica has a higher density of population that will use the pool so for now the Directors and Officers of the Board are choosing to keep the pool closed for the safety of the population. Additionally, these strict guidelines INCREASE the liability not decrease the liability.
When will the pool be opened?
We do not have any indication from the Palm Beach County officials that the Governor will “open” the community pools in Phase 2 of opening. As soon as the Order is lifted for pool closure, your pool will be open. You may see some pools open but many are just for “laps” and “exercise/physical therapy” - not for sunbathing, playing, or open swim time.
Why can’t we volunteer and keep the pool open ourselves?
Monitors become responsible for the guests following the guidelines. Anyone not practicing social distancing and abusing the rules will have to be called out and told to leave. We do not want any volunteer monitor to be in any sort of liability position.
Why can’t we pay a security company to manage the Order No. 7?
Your budget for your quarterly dues was approved and done for 2020. Paying for monitors may result in higher dues and/or a special assessment to pay for the security services.
