On July 17 2025 while burying his guinea pig Emmanuel and his brother Evan were shot at by a neighbor. Subsequently Emmanuel was in ICU for 15 days almost losing his life. After a year of fighting for justice the shooter went to jail today. Justice takes time but justice comes for those who fight for it. To the Menchaca's: may this bring some closure to you and may you know begin the long road ahead of healing.

🚨 IMPORTANT IMMIGRATION UPDATE: ADVANCE PAROLE🚨

The Board of Immigration Appeals (BIA) has issued a major new decision regarding Advance Parole.

In Matter of Delcarmen-Lara, the BIA ruled that traveling outside the United States with
Advance Parole can now count as a departure for purposes of the 3-year and 10-year unlawful presence bars.

WHAT DOES THIS MEAN?

Previously, under traveling with Advance Parole generally did not trigger these unlawful presence bars.

The BIA has now overruled that decision.

This change may have serious consequences for certain individuals who accumulated unlawful presence in the United States before traveling.

DO NOT PANIC — BUT DO NOT TRAVEL WITHOUT GETTING LEGAL ADVICE.

Every immigration case is different. This decision does not automatically mean that everyone with Advance Parole is subject to a 3-year or 10-year bar. Your immigration history, age when unlawful presence was accumulated, previous entries and departures, and other circumstances can affect how this decision applies to you.

If you currently have Advance Parole or are considering applying for it, we strongly encourage you to speak with a qualified immigration attorney or accredited legal representative BEFORE leaving the United States.

If you have already traveled with Advance Parole, do not assume that this decision automatically affects your case. Seek individualized legal advice before making decisions about your immigration case.

This is a new and significant development in immigration law, and we will continue monitoring its implementation and any additional guidance.
