WAIKIKI NEIGHBORHOOD BOARD No 9
Resolution 2023-3
Regarding Reduction of Vehicle Noise
WHEREAS, the Waikiki neighborhood is now subjected to unprecedented levels of noise pollution; and
WHEREAS, noise pollution is an important quality-of-life issue that negatively impacts the health of both humans and animals; and
WHEREAS, vehicles—mechanized personal transportation devices with two or more wheels, such as mopeds, motorcycles, and automobiles—are a primary source of noise pollution; and
WHEREAS, many vehicles that drive through Waikiki have audio, muffler, horn, or other component systems which disturb the peace and tranquility of life and subject neighborhood residents to unreasonable levels of noise at all hours of the day and night; and
WHEREAS, Hawaii Revised Statutes §711-1101 declares noise to be unreasonable if it “involves a gross deviation from the standard of conduct that a law-abiding citizen would follow in the same situation”; and
WHEREAS, Waikiki Neighborhood Board No 9 finds many vehicles in Waikiki create excessively loud and disturbing noises which grossly deviate from standard and reasonable levels of community conduct and propriety; and
WHEREAS, noise-monitoring technology is now available for installation on City traffic poles which may permit the Honolulu Police Department to enforce state and local noise statutes without reduction of officers on patrol; now, therefore be it
RESOLVED THAT Waikiki Neighborhood Board No 9 calls upon the City, through its Police Department and Prosecuting Attorney’s Office, to enforce and prosecute current muffler, horn, excessive noise, and disorderly conduct laws to address the significant disruption that non- compliant vehicles and noise from same bears upon residents of Honolulu; and be it further
RESOLVED THAT to act in a manner likely to be of practical benefit to residents, the City Council create a committee or advisory panel to collect testimony and ideas about tenable solutions from residents impacted by chronic noise; and be it further
RESOLVED THAT this resolution is to be distributed to the Mayor, City Council, Honolulu Police Department Chief, and the Office of the Prosecuting Attorney for action.
