For some 18-year-olds with Autism Spectrum Disorder (ASD) in Nevada, guardianship may be necessary to ensure their well-being and ability to make informed decisions about important aspects of their lives.

Why guardianship may be needed:

Difficulty with decision-making: Some individuals with ASD may have challenges understanding, communicating, and making decisions regarding their healthcare, finances, and living arrangements.

Protection from exploitation or harm: Guardianship can help protect a vulnerable adult from potential exploitation or situations that could lead to serious injury or illness.

Ensuring access to care and support: A guardian can advocate for the individual's needs and ensure they receive necessary care, support, and services.

In Nevada, the process for establishing guardianship for an adult involves:

Filing a petition with the court: This is the first step in seeking guardianship.

Providing evidence of incapacity: The court requires evidence, often including a physician's affidavit, demonstrating that the individual is unable to make informed decisions and care for themselves.

Court hearing: A hearing will be held where the judge will determine if guardianship is necessary.

Consideration of less restrictive alternatives: Nevada law requires exploration of alternatives to guardianship before an order is granted.

Autism doesn’t end at 18. It doesn’t disappear after childhood. Adults on the spectrum exist—and they need support, inclusion, employment opportunities, and respect. We talk so much about early intervention, but what about long-term acceptance? Autistic people grow up. The world needs to grow with them.

In 2020, CCSD enrolled 319,917 students in prekindergarten through grade 12. Of those enrolled, 40,020 students, or 12.5 percent, had Individualized Education Plans (IEPs). In that same year, CCSD reportedthat 16 percent of its enrolled population carried a diagnosis of autism spectrum disorder, totaling 51,186 students. CCSD data also shows that students with disabilities in Clark County were educated in general education classes at a much lower rate than other districts and were more likely to be isolated. They were also more likely to be suspended out of school than students without IEPs.
