"What even are deed restrictions?"
Thinking about buying a deed-restricted home in Gunnison County? Here's the one thing to note first: read your deed restriction. When you buy a deed-restricted home, you're buying into every condition written into that deed. These are legal agreements that set who can own the home, how it's used, and what happens when it sells. They exist because public dollars helped build these homes to keep them affordable for our local workforce and thus, their are specific restrictions that are imposed in exchange for that public benefit.
A few terms you'll often see (though every restriction is different):
- Primary residency + local employment requirements
- Income or asset limits at the time of purchase
- Owner-occupancy rules
- Appreciation caps that limit resale price — often 2–3%/year, though some units have none
Compliance is ongoing, not a one-time check, and these terms are very difficult to change later — so never buy assuming you can adjust them down the road.
