🚨 Olmstead Update 🚨

Did the Department of Justice change its approach to Olmstead?

Yes.

The U.S. Department of Justice (DOJ) announced that it will no longer use its previous Olmstead guidance when enforcing Title II of the Americans with Disabilities Act (ADA).

The previous guidance explained:
🏠 How the ADA protects people with disabilities from being unnecessarily placed in institutions.
🀝 That states have a responsibility to provide services in the most integrated setting appropriate, such as a person's own home or community.

The DOJ says the guidance is not legally binding and plans to review it. The guidance may be changed or replaced in the future.

What does this mean?
This announcement changes how the DOJ will use its previous guidance when enforcing the ADA. It does not change the text of the ADA or the Olmstead Supreme Court decision. Advocates across the country are closely following these developments and what they may mean for people with disabilities.

Today we celebrate the birthday of the Americans with Disabilities Act (ADA)! πŸŽ‰β™Ώ

For 36 years, the ADA has helped open doors, remove barriers, and protect the civil rights of millions of people with disabilities. While we celebrate the progress that has been made, we also recognize that there is still work to do to ensure every person can fully participate in their community.
