Breaking good news!!! Thanks to all the calls and emails to state legislators in opposition HB2151, tomorrow’s committee vote has been cancelled/postponed!! Word is there is going to be significant changes made to it.

I think we can all agree with legislators who are looking for a way to help municipalities enact ordinances that will protect communities and environment from data centers. But what is proposed in HB2151 would not do that.

🔴 If legislators are looking for a real solution, it would be to put forward a bill for a statewide moratorium on new data center development allowing municipalities a reasonable amount of time to put protective ordinances in place and for the state to put guardrails in place.

🚨A bill to silence local opposition to data center development is being rushed through the state house.

HB2151 would authorize the Department of Community and Economic Development ( DCED) to write a data center ordinance and put it in the municipal planning code

🔴 Let’s be clear: the role of DCED isn’t to ensure zoning integrity and protect residents. Its role is to advance development - and for months if not years, this department has been making backroom deals to fasttrack and facilitate data center industry with big tech and big energy , especially Amazon web services

✅ Contact your state rep now. Urge them to vote NO on HB2151. Amazon and other big Tech and big energy corporations should not be involved in the writing of local ordinances. 🔴There are no amendments that could make this a good bill - because it puts DCED in charge, it is bad to its core

GREAT NEWS …. This past Friday, January 30th, Lackawanna County Court Judge Mark J Powell ruled that the settlement agreement the Clifton Township supervisors made with the data center on January 2nd will be thrown out. The judge agreed that the supervisors do NOT have the right to override the zoning board. The data center’s original appeal to the zoning board’s ruling, will now continue in court and hopefully the judge will agree and rule that the Clifton Township’s zoning ordinance is not exclusionary. Thank you Judge Powell!!

Heads Up! Kat Bolus from WVIA News is finally going to print an article she has been working on since July about the Clifton, Covington Township Data Centers. It is a 3-part article starting on this Sunday, Monday then Tuesday. In addition, there will be a keynote additional article to run on February 16th in more in-depth effects on the property owners in the area.

Update: we think it went well!! Judge should make a decision soon!
Please 🙏 and send all your positive thoughts to Judge Powell’s chambers today in Lackawanna County Court. Arguments (being heard by Judge) from Clifton Township Zoning Boatd’s solicitor and Clifton Township Supervisors’ solicitor regarding the zoning board’s petition to strike order approving settlement agreement. Only lawyers were invited to zoom meeting and the public is not able to observe. I believe Covington’s attorney may be there also.
