From ANCOR:

On August 5 the Senate Homeland Security and Governmental Affairs Committee will markup the Recognizing the Role of Direct Support Professionals Act (S. 3211), which urges the creation of a standard occupational classification (SOC) for direct support professionals (DSPs).

During the markup, committee members will review the bill and vote on whether to move it forward. This is an exciting step toward achieving our goal of establishing a SOC for DSPs.

Now, more than ever, we need your help to ensure the success of this legislation. We urge you to take a moment today to contact your members of Congress and express your support for the Recognizing the Role of Direct Support Professionals Act.

During the last Congress, the Recognizing the Role of Direct Support Professionals Act passed unanimously through the Senate. Next week’s markup is the latest step on this bill’s path to passage. With your help in keeping up the pressure and urging all members of Congress to support this bill, we can strengthen the direct support workforce and the critical services they provide to people with disabilities every day.

Thank you for your steadfast advocacy on behalf of our direct support professional workforce and people with disabilities. Your commitment is the driving force behind our progress and we are deeply grateful for your ongoing support.

The bipartisan Recognizing the Role of Direct Support Professionals Act urges the Office of Management and Budget to establish a Standard Occupational Classification (SOC) for direct support professionals (DSPs).

Article 17A vs. Article 81 Guardianship:
When a loved one needs help making important legal decisions, many families know to turn to guardianship. In reality, New York offers different types of guardianship, each designed for a different purpose.

Article 17-A Guardianship
Article 17-A Guardianship was created specifically for adults with intellectual or developmental disabilities. It is often considered when a child with special needs turns 18 and parents need the legal authority to continue making decisions regarding medical care, education, services, living arrangements, or finances.

This type of guardianship is heard in Surrogate's Court and is intended for individuals whose disability impact their ability to make informed decisions and act on them in a responsibly way.

Article 81 Guardianship
Article 81 Guardianship is for individuals who are unable to manage personal or financial affairs because of incapacity, regardless of the underlying cause. This type is typically used when an individual develops dementia, a traumatic brain injury, or a severe mental illness.

Unlike Article 17-A, Article 81 is designed to be tailored to the individual's specific needs. Rather than restricting the individual across the board, the court determines exactly which powers a guardian needs and preserves as much of the individual's independence as possible.

Article 81 proceedings are heard in Supreme Court or County Court.

When an an individual has a developmental disability they are most likely going to need 17-A guardianship. Article 81 is usually used when an individual becomes incapacitated later on and did not set up Advance Directives before reaching that point.

Because every situation is unique, it's important to speak with an attorney who understands New York guardianship law and can help you determine the best path forward.

Protect TPS Holders and the Direct Care Workforce New Yorkers Depend On

The Supreme Court's recent ruling in Mullin v. Doe stripped away judicial review of Temporary Protected Status (TPS) terminations, clearing the way for hundreds of thousands of TPS holders, including direct care workers who support New Yorkers with Intellectual and Developmental Disabilities (I/DD), to lose their work authorization and face deportation. For an already strained direct care workforce, this means disability service providers will lose staff they are dependent upon, threatening the care and support individuals with I/DD need to live.

Congress has two opportunities to act right now:

H.R. 1689 would extend Haiti's TPS designation through 2029 and has already passed the House with bipartisan support. It's currently awaiting a vote in the Senate.
H.R. 9523, the TPS Relief Act introduced by Rep. Seth Moulton, would restore the courts' authority to review TPS terminations for any country going forward.

We're asking you to support both. Demand a floor vote on the Senate's Haiti TPS extension. Advocate and vote for H.R. 9523 in the House. New Yorkers with disabilities depend on a stable, dedicated direct support workforce and that workforce depends on Congress acting before more people lose the ability to legally live and work here.
