In Texas, like in many states, there are provisions regarding workers' compensation and cancer presumption specifically tailored to firefighters. These provisions are designed to provide support to firefighters who develop certain types of cancers due to their work-related exposures. Here's a general overview of workers' compensation and cancer presumption for firefighters in Texas:

1. **Cancer Presumption:** The cancer presumption law essentially means that if a firefighter develops certain types of cancers, it is presumed that the cancer was caused by their job-related activities unless proven otherwise. This presumption can make it easier for firefighters to receive workers' compensation benefits for these specific cancers.

2. **Qualifying Cancers:** The list of qualifying cancers may vary from state to state. In Texas, the types of cancers covered by the presumption law generally include cancers such as lung, bladder, skin, brain, leukemia, lymphoma, and more. The list can change over time as legislation is updated.

3. **Exposure Requirements:** To qualify for the cancer presumption, firefighters typically need to have been exposed to certain hazardous conditions as part of their duties. These conditions might include exposure to smoke, toxic fumes, chemicals, and other substances commonly encountered at fire scenes.

4. **Time Requirements:** In some cases, there might be specific time requirements or minimum years of service that a firefighter needs to have completed to be eligible for the cancer presumption. This is to establish a link between their exposure and the development of the cancer over time.

5. **Rebuttal:** While the presumption is designed to make it easier for firefighters to receive compensation for work-related cancers, it's not absolute. Employers or insurers might still try to rebut the presumption by providing evidence that the cancer was not caused by work-related activities.

6. **Benefits:** If the presumption is not rebutted, the firefighter may be eligible for various workers' compensation benefits, including medical treatment, disability benefits, and more.

It's important to note that workers' compensation laws and regulations can be complex and may change over time. If you're a firefighter in Texas seeking information about cancer presumption and workers' compensation, it's recommended that you consult with legal professionals or appropriate authorities who are well-versed in the current laws and regulations specific to your situation.

FWFD Lt David Dodson, retired in 2019(4 years ago) diagnosed with Cancer in July 2023.
In Texas, firefighters have no presumptive cancer coverage for the first 5 years of their ff career and they lose presumptive cancer coverage the MOMENT they retire. This isn’t right and MUST change!
David is getting the best treatment possible at MD Anderson cancer care center…cancer can’t keep this retired Fort Worth Firefighter down!!!

A short video from Chief Goldfeder and link to the National Firefighter Cancer Registry. I’m adding my name to the list because workers compensation laws for presumptive firefighter cancer have to be improved and extended into retirement years at a federal level.

Many chemicals and carcinogens firefighters are exposed to are known to cause cancer in firefighters up to 50 years after exposure. Currently, the State of Texas has ZERO presumptive workers comp coverage for retired firefighters who get cancer.

Workers compensation has been broken for quite some time and this is one way we can show them our names to shine a light on how many of us have been affected.

The Flower Mound Fire Department is saddened by the loss of Firefighter/Paramedic G. Wade Cannon. Firefighter Cannon passed away last night after a valiant battle with occupational colon cancer. Firefighter Cannon was 33 years old and served the Town of Flower Mound for 6.5 years. Our thoughts and prayers are with his family and friends.

Additional details regarding the Line of Duty memorial service will be released at a later time.

In lieu of flowers, the family asks for donations to be made in Wade’s name to organizations that were near and dear to them during their cancer battle. Please consider donating to the Brent Lewis Bridges Foundation and Michael's Memories.
