The city-wide boil water notice that was issued on Saturday, September 11, 2021 has been rescinded (with a few exceptions listed below) having received results from the Health Department for 2 consecutive days of bacteriological evaluation.

The city-wide rescission includes: Residents on boil water notice on the Friday, September 10, 2021 boil water notice for a 16” water main break at Kingsbridge at Plantation Gardens Boulevard and the affected areas bounded by Plantation Garden Boulevard on the North, Commerce Lakes Drive on the East, Daniels Parkway on the South and Treeline Avenue on the West.

There are 24 specific locations within the evaluated area where the boil water notice will continue:
• 36 residents affected by the 10” water line break at 4577 Water color Way (Ward 6) which was a separate water main break event that occurred on Sunday, September 12, 2021, at approximately 1:30 pm. These 36 residents have been contacted to continue the boil water notice until further notice.
• An additional 23 individual locations that showed anomalies for further investigation as part of the City’s survey. These individual entities have been contacted to continue the boil water notice until further notice

ATT PLEASE!! Florida’s General Attorney Ashely Moody just called out the City of Fort Myers!!!! 👀👏

FL. POLITICS— Ashley Moody’s office recognizes 1st Amendment right to request charity. When will cities finally see the same?

Trying to keep certain people out of view is no answer. Freedom of speech is a constitutional right that we all share, regardless of our religious or political beliefs, our age, race, ethnicity, or our financial or housing status.

Just as we have the right to discuss religion, politics, the environment, education, and any other topic we see fit, so too do we have the right to ask for help.

Yet cities throughout Florida keep passing laws criminalizing the act of asking others for charity, also known as panhandling. They also continue to waste taxpayers’ money by going to court to defend these laws that blatantly violate the U.S. Constitution.

The latest city to lose in court is Fort Myers. It enforced an ordinance making it a crime for an individual to “ask, beg or solicit alms” in a public place. David Watrous was convicted of that crime after he requested charity at the Rosa Parks bus station in Fort Myers in 2019.

On Aug. 11, a Florida appeals court overturned his conviction on freedom of speech grounds.

The defeat suffered by Fort Myers in the Watrous case was predictable. Even Ashley Moody, Florida’s Attorney General, had conceded in court filings that the Fort Myers ordinance violated the First Amendment.

In its brief to the 2nd District Court of Appeal, the Attorney General’s Office recognized, “a homeless man holding a sign on a street corner soliciting alms from passing cars is no more a threat to traffic safety than local basketball team members waving signs at passing cars to advertise their car wash.”
