AFGE Condemns Trump's Retaliatory Attempt to Outlaw Federal Unions

AFGE President Everett Kelley Issues Strong Rebuke to Retaliatory Executive Order Targeting Federal Employees' Union Rights

WASHINGTON – American Federation of Government Employees (AFGE) National President Everett Kelley today issued the following statement in response to President Trump’s latest executive action attacking the collective bargaining rights of over one million federal employees:

“President Trump's latest executive order is a disgraceful and retaliatory attack on the rights of hundreds of thousands of patriotic American civil servants—nearly one-third of whom are veterans—simply because they are members of a union that stands up to his harmful policies.

"This administration’s bullying tactics represent a clear threat not just to federal employees and their unions, but to every American who values democracy and the freedoms of speech and association. Trump’s threat to unions and working people across America is clear: fall in line or else.

“These threats will not work. Americans will not be intimidated or silenced. AFGE isn't going anywhere. Our members have bravely served this nation, often putting themselves in harm’s way, and they deserve far better than this blatant attempt at political punishment.

“AFGE is preparing immediate legal action and will fight relentlessly to protect our rights, our members, and all working Americans from these unprecedented attacks.”

Fast Facts: Federal Sector Collective Bargaining
Federal unions cannot negotiate over pay, benefits, or hiring/firing decisions.
Unlike private-sector unions, federal unions are limited to bargaining over conditions of employment—not wages, benefits, or classifications, which are set by law and Congress.

**Federal employees are prohibited by law from striking.

Under 5 U.S.C. § 7311, federal workers are legally barred from striking, and doing so can result in termination and a ban from federal employment.

Nearly one-third of federal employees are veterans.

Many federal workers are former service members who bring leadership, discipline, and mission commitment to their civilian roles. Stripping their bargaining rights is a betrayal of that service.

Collective bargaining is governed by the Civil Service Reform Act of 1978.

This bipartisan law created a structured process for federal workers to address workplace issues without disrupting government operations.

Unions improve agency performance—not hinder it.

Collective bargaining helps resolve conflicts early, reduces costly litigation, improves retention, and boosts morale—all of which support better public service.

Removing bargaining rights opens the door to abuse.

Without union representation, employees—especially whistleblowers and veterans—lose vital protections from retaliation and political interference.

Federal unionism has broad historical support.

Federal Court Finds Firing of Probationary Federal Employees Illegal

Judge Alsup calls probationary federal employees “the lifeblood of our government”

SAN FRANCISCO – Today, the U.S. District Court for the Northern District of California, presided over by Judge William H. Alsup, granted a temporary restraining order against the Office of Personnel Management (OPM) and its Acting Director, Charles Ezell, finding the termination of probationary federal employees illegal because OPM had no authority to order it. Judge Alsup said that when federal agencies fire employees for no reason, “that’s just not right in our country,” adding that we can’t “run our agencies with lies.” “The Office of Personnel Management does not have any authority whatsoever under any statute in the history of the universe to hire and fire employees at another agency,” he stated.

The judge ordered OPM to immediately notify federal agencies of the ruling, including the Department of Defense, which is poised to terminate thousands of probationary employees tomorrow. Judge Alsup further ordered the federal government to disclose by Tuesday the participants on the February 13 call that has been widely reported to have been the occasion when OPM ordered the agencies to terminate probationary employees. He indicated that a longer written order would follow shortly on the heels of today’s ruling from the bench.
The coalition of plaintiffs on the case include the American Federation of Government Employees (AFGE); American Federation of State, County and Municipal Employees (AFSCME); the Main Street Alliance; the Coalition to Protect America’s National Parks; the Common Defense Civic Engagement; the Western Watersheds Project; AFGE Local 1216; AFGE Local 2110; VoteVets; and United Nurses Associations of California/Union of Health Care Professionals (UNAC/UHCP). They are represented by the law firm of Altshuler Berzon LLP and the State Democracy Defenders Fund (SDDF).

The plaintiffs had the following responses to the decision:

“This ruling by Judge Alsup is an important initial victory for patriotic Americans across this country who were illegally fired from their jobs by an agency that had no authority to do so,” said Everett Kelley, National President of the American Federation of Government Employees. “These are rank-and-file workers who joined the federal government to make a difference in their communities, only to be suddenly terminated due to this administration’s disdain for federal employees and desire to privatize their work. OPM’s direction to agencies to engage in the indiscriminate firing of federal probationary employees is illegal, plain and simple, and our union will keep fighting until we put a stop to these demoralizing and damaging attacks on our civil service once and for all.”

“We know this decision is just a first step, but it gives federal employees a respite. While they work to protect public health and safety, federal workers have faced constant harassment from unelected billionaires and anti-union extremists whose only goal is to give themselves massive tax breaks at the expense of working people. We will continue to move this case forward with our partners until federal workers are protected against these baseless terminations,” said AFSCME President Lee Saunders.

“This decision by Judge Alsup is a major win for Main Street. The mass firings of Small Business Administration employees creates uncertainty for time-strapped entrepreneurs. Chaos is the enemy and this ruling brings a little bit more peace of mind to small business owners that keep our economy going,” said Richard Trent, Executive Director for the Main Street Alliance.

“This ruling is a win for National Park Service employees who have been wrongfully fired across the country,” said Phil Francis, Chair of the Executive Council of the Coalition to Protect America's National Parks. “NPS employees are dedicated to protecting the irreplaceable resources and stories found at over 430 units of the National Park System. Without our park rangers, our national parks - and the ability of Americans to safely visit them - are at risk. We applaud today’s ruling and we look forward to continuing the work to ensure our parks and people are protected.”

“The recent mass layoffs have disproportionately affected Veterans, leading to job losses and increased uncertainty. This ruling is a win for the Veterans who have been impacted and rely on federal employment for stability, and these cuts have disrupted their livelihoods,” said VoteVets Action Fund Chairman Major General (Ret.) Paul Eaton.

“The rule of law applies to everyone, including presidential administrations,” said Erik Molvar, Executive Director of Western Watersheds Project. “Federal land and wildlife agencies need staff to enforce environmental protection regulations and keep an eye on western public lands, so we are pleased that the courts have struck down these illegal firings.”

"This is a win for the thousands of public servants who keep our country running, for veterans and their families who rely on the Department of Veterans Affairs and other agencies, and for the millions of Americans who depend on critical government services,” said Jose Vasquez, Executive Director of Common Defense. “The court’s decision stops a blatant power grab that threatened to gut essential services, from veterans’ healthcare to disaster relief. Today, justice prevailed, but our fight continues to ensure no administration can ever again play politics with the livelihoods of those who serve our country and our communities.”

“The law is clear that OPM has no authority to order the federal agencies to fire their employees. Today’s ruling is an important first step in holding this administration accountable for these unlawful acts,” said Danielle Leonard, Altshuler Berzon, representing the plaintiffs.

“Today’s decision is an important victory for the rights of federal workers. The work done by the plaintiffs, led by public service unions along with small business, veterans, and conservation organizations, has been extraordinary and tireless,” said Norm Eisen, executive chair of State Democracy Defenders Fund. “Together, we’re going to keep holding this administration accountable whenever and wherever they try to undermine the rights of the people of the United States under the cynical guise of reform.”

Mass Layoff of Federal Workers Will Mean “Fewer Services at Higher Costs” for Taxpayers, Union Says

Administration has targeted all federal workers, AFGE says

WASHINGTON – American Federation of Government Employees National President Everett Kelley today issued the following statement in response to the Trump administration calling for large-scale cuts to the federal workforce through a huge reduction in force:

“The federal government is the sum of its people – 2.3 million patriotic Americans who serve this country with honor and distinction, including more than 600,000 veterans. Over the past five weeks, the Trump administration has fired thousands of workers responsible for maintaining our national parks and forests, serving our veterans, and processing American’s tax returns. They enticed workers to quit with the wasteful and illegal promise they would get months of pay for doing nothing. They began the illegal and indiscriminate mass firing of probationary employees across our federal agencies. And now they are going after the rest of the federal workforce.

“Laying off potentially hundreds of thousands of federal workers will mean fewer services at higher costs for the American taxpayer. Longer waits at VA hospitals, fewer inspectors ensuring the safety of our meats and produce, less research into cures for debilitating and deadly diseases, more risks for air travelers, longer waits for Social Security enrollment and passports, and the list goes on. What it will not do is result in any discernable savings for taxpayers – in fact, taxpayers likely will end up paying more as the essential work our government does is sold off to private, for-profit contractors.

“This administration has targeted every single federal worker and does not seem to care how much turmoil they cause for either the employees or the American public. The chaos is the point.

“We will not stand idly by as President Trump, Elon Musk, and their lackies run roughshod over the Constitution, federal law, and basic human decency.”

Earlier today, I sent a letter to Acting OPM Director Ezell insisting he rescind yesterday’s email from [email protected]. Since last night, it has become even more clear that the thoughtless and bullying email was meant to intimidate federal employees and cause mass confusion. Agencies across the federal government have acknowledged that confusion and that they were unaware the email was being sent. As of this writing, several agencies have now provided guidance to employees.

Though we believe the email and the resulting agency instructions are improper, we advise that you comply with any directive that has come from your agency. Simply put, if your agency has asked you to reply, you should do so and highlight the important work that you do for the American people. If you are in a situation where you have been prevented from performing your duties by the current administration’s attacks (USAID, for example), say so, as well as the positive contributions you would be making were you permitted to work as usual. If you have engaged in advocacy for your agency or protected activity, I would also note that and simply state that you have continued to stand ready to support your agency, its mission, and the public.

If your agency has informed you that you should not respond, you should comply with that directive. Similarly, if you have not received any guidance from your agency, we reiterate our advice from yesterday that you should ask your supervisor whether you should respond and, if so, how. Until you receive a response or other agency directive to respond, we do not believe you have any obligation to do so.

Finally, if you are on leave, we do not believe you have any obligation to respond. If you wish to respond, you may wish to ask your supervisor for any overtime or compensatory time that you may be entitled.

AFGE will continue to monitor the situation and provide further updates as necessary. Separate guidance for local leaders will be issued later today.
