Unfortunately, Waste Management's operating permit expiration date has come and gone (yesterday) and DEC is still communicating with Mr. Penfold about it. Of course, we had all hoped that DEC would shut him down, but they didn't. And so, the battle goes on.

We have our November-December meeting this Sun. (11/24) at Noon at The Hoag. Please make every effort to come.

Local Candidate Rollcall on Blocking Further Landfilling in Albion

Upon checking with the below Albion Town Board candidates and the Orleans County Legislature candidates for the Albion-Gaines District and the Legislator-At-Large Central District, all stated that they opposed further landfilling in Albion.

SPOC MTG. 10/19/13

We are still requesting and receiving donations.
Several local Town Board and County Legislature candidates were in attendance.
Letters of support from neighboring municipalities are in the process of being written.
Penfold's DEC application remains insufficient at this time.
SPOC has retained an attorney.
Leachate tests on OSL have concluded and results can be foiled in 60-90 days.
Publicity and Education remain important especially with upcoming elections.
Next mtg. is Nov. 17 12 pm at HOAG.

There was a miscommunication regarding the time of the Murray town board meeting - it appears to have been an error on the part of the Town Clerk. The meeting started at 6PM and we got there at 7PM. As a result, we (6 SPOC members) missed the discussion about the landfill.

I spoke up during the "Public Comment" period at the end of the meeting and learned that although the board doesn't want to see the landfill reopen, before writing a letter per our request, they want information on the leachate testing that was just (ended last week) done and on the remediation plan, if it's found that there's a problem. I informed the board that I was disappointed that they had not taken action on our request and pointed out that if there's a problem, adding more trash is ludicrous and certainly not the solution. I ended by stating that we would get them the information that they want as it becomes available to us.

SPOC reps have approached the Town of Barre and the Village of Medina. It is not anticipated that there will be any problem in getting a letter of support from either. The Village of Albion will also be approached soon.

I called the Assistant Regional Attorney at DEC today and told her that if their rules permit it, if they meet with Mr. Penfold regarding his renewal application, we would like our attorney, Gary Abraham, to be present. She indicated that if they decide to meet (TBD) with Mr. Penfold on his application, she will check to see if Mr. Abraham's presence is appropriate. I made it VERY clear to her that we do not feel that there is any link between Mr. Penfold's company and Waste Management's permit to operate at the OSL site.

The DEC attorney also informed me during this call that they had just received (dated 9/24/13) Mr. Penfold's response to their "Notice of Incomplete & insufficient Application". She further informed me that she had not had a chance to review it yet. It is extensive with several documents attached. (We will FOIL it.)

Re-opening the landfill that sits right next to the Erie canal flies in the face of the county and state's efforts to promote tourism on the canal. Rotting garbage and hovering seagulls are not appealing to tourists.
