The Dunn v. Wisconsin PSC youth plaintiffs are fighting for their day in court.

After a lower court dismissed their case, they appealed, asking the Wisconsin Court of Appeals to allow their constitutional claims to be heard on the merits.

On Tuesday, the Ninth Circuit dismissed Lighthiser v. Trump. The ruling follows oral argument in April, where the youth plaintiffs asked the Court to reverse a lower court decision that dismissed their case before trial and prevented them from presenting their full evidentiary record.

The decision creates a dangerous accountability gap. It lets the President direct a sweeping fossil fuel agenda and then tells the children harmed by that agenda that they cannot challenge it as a whole.

Attorneys for the youth plaintiffs are reviewing the decision carefully and assessing all legal options. The courage of these 22 young people has not changed. The facts have not changed. And the pursuit of their constitutional rights continues.

Nearly two years after Hawaiʻi youth secured a landmark settlement in Navahine v. HDOT, the implementation work continues.

Transportation is Hawaiʻi's largest source of greenhouse gas emissions. Expanding EV infrastructure helps make cleaner transportation more accessible and affordable while reducing climate pollution that threatens young people's constitutional rights.
