Oregon Legislative Update
Here is an update on legislation of particular importance. We are still waiting on a handful of bills to be signed and given a chapter number.
OCDLA Proposals (HB 4041)
• Reclassifying two misdemeanor Driving While Suspended offenses as violations. Effective January 1, 2027.
• Adjusting the dollar thresholds for Theft and Criminal Mischief to account for inflation. Effective January 1, 2027.
District Attorney Proposals (HB 4041)
• Credit for Time Served/Torres-Lopez (addressing notice, computation of credit for time served, and entry of a corrected judgment). Effective March 5, 2026.
• One final extension of the deadline to file a PCR based on a non-unanimous verdict. Effective March 5, 2026.
• Felony Elude (HB 4041). Effective on January 1, 2027.
DOC recapture provision (HB 4041). Effective March 5, 2026.
Other Notable Bills
• S*x Trafficking Hearsay Exception. Effective June 5, 2026.
• Out-of-Custody arraignment period extension. Effective June 5, 2026.
• Swatting. Awaiting the Governor’s signature.
• Wrongful conviction compensation and PCR based on discredited junk science (creates a process for a person to file a PCR petition “based in whole or in part on scientific expert testimony, scientific expert evidence or scientific expert opinion derived from the application of one or more of the following discredited forensic science disciplines: Hair microscopy; Bite mark analysis or bite mark comparison; or Comparative bullet lead analysis). Awaiting the Governor’s signature.
• Oregon Foster Children's Bill of Rights and the Oregon Foster Children's Sibling Bill of Rights. Signed by the Governor, but still awaiting a chapter number.
• Pretrial release orders and automated license plate readers. Signed by the Governor, but still awaiting a chapter number.
• Allows a community mental health program director to notify the court within two judicial days (instead of “immediately”) when a defendant found unfit to proceed is not complying with community restoration services. Effective on January 1, 2027.
