The housing conversation is entering a critical point in Delaware this week. Currently, 50% of Delaware renters are cost-burdened, spending 30% or more of their income on housing. 21% of Delaware homeowners are also cost-burdened by their mortgage. And we are 20,000 affordable units short of what lower-income renters need statewide.

SS2 to SB 23 aims to address those issues by giving every Delaware county and municipality over 2,000 residents a clear, flexible playbook for growing housing supply and diversifying housing options WITHOUT dictating a one-size-fits-all solution. It will be heard in the House Housing Committee on June 16 at 10:00 a.m.

SS2 for SB 23, the Housing for Every Delawarean Act, has passed the Senate and now moves to the House! It will be heard in the House Housing Committee on Tuesday.

Reach out to your Representatives and let them know that you think every Delawarean deserves a place to live and that this bill will help achieve that by providing a menu of options for local governments to chart that path.

CALL-TO-ACTION:

SS2 for SB 23 gives every Delaware county and every municipality over 2,000 residents a clear, flexible playbook to grow housing supply and expand housing options.

Every jurisdiction writes its own Affordable Housing Plan with a concrete strategy to reach 20% affordable housing and chooses its own tools to get there, including but not limited to density bonuses, fee waivers, transit-oriented zoning, by-right approvals, fewer parking minimums, and more.

This bill benefits working families, seniors, and fixed or low income Delawareans across the state by creating more opportunities for starter homes, rental units near jobs, and housing units with smaller footprints like ADUs, cottage housing, and senior-friendly multifamily.

We have filed a lawsuit in Delaware Superior Court challenging the legality of the City of Lewes’s building permit fee structure, arguing the city is unlawfully using building permit fees as a revenue-generating tool in violation of Delaware law, the city’s own charter, and constitutional protections.

The lawsuit alleges that the City of Lewes doubled its building permit fee from 1.5% to 3% of construction costs specifically to generate additional municipal revenue, despite already collecting permit fees far exceeding the actual cost of administering its building department.

HBADE is prepared to stand up against unlawful attempts to increase the cost of housing anywhere in this state.
