AAA board member Tim Johnson participated in an insurance task force appointed by the Minnesota Legislature last year.

Even if you're not in Minnesota, the report is worth reviewing. Most of the issues considered and the sources referenced are not unique to Minnesota. This report provides a very rare glimpse into how the sausage is made (i.e. how legislative agendas around these issues are set).

HB 568:
-Prohibits the issuance of any new public adjuster licenses.
-Prohibits public adjusters from negotiating claims with insurers.
-Places a 5% cap on public adjuster fees.
-Introduces a 30 day rescission period for public adjuster contracts.

This bill does everything but outright outlaw public adjusting. It must be stopped!

The Kentucky legislature introduced a bill that would scrap public adjusting in the state. The same legislature introduced another bill that would greatly restrict contractors too.

Both bills are terrible in their own right. In tandem, these bills completely remove policyholder advocates from the field -- leaving homeowners without access to the help so commonly needed after a loss.

Please stand with us in fighting against these brazen attempts to abolish consumer access to professional claim representation.

About a week ago, over a dozen members of Congress wrote a letter to major insurers in California.

The signers chastised the insurance companies for making the claims process more difficult than it needed to be. The Congressional letter concluded by asking the insurers to answer a number of questions about their handling of fire victims' claims.

The Oklahoma Attorney General has filed a significant motion against State Farm, alleging that the company used an internal “Hail Focus Initiative” to systematically underpay or deny legitimate hail and wind damage claims.

According to the filing, this program relied on undisclosed internal standards (not the coverage customers believed they were paying for) resulting in homeowners receiving far less than they were owed.

Cases like this shed light on a critical issue in our industry: when insurers control the claim process from start to finish, where does that leave the policyholder?

About the American Adjuster Association

Insurance provides protection against the unforeseen and unplanned things that can happen in life. When you buy insurance for yourself, your home or your business you are transferring the cost of a potential loss to the insurance company in exchange for a fee known as a premium.

If you are like most people you pay your insurance premium monthly or yearly for this added layer of protection. Should you suffer a covered loss your insurance company will cover the costs to make you whole again.

Or so you hope.

Many people will file an insurance claim, provide documentation to prove the loss and submit receipts for covered items only to have their claim wrongfully denied or underpaid. Policyholders are then left with two choices: hire and pay out of pocket for industry experts, lawyers and expensive trials or pay out of pocket to fix and repair what should have been covered by their insurance policy. In either situation, the policyholder loses.
