An ACLU report found that jury racial discrimination in the state of Kansas is not an isolated problem but a systemic failure of how capital juries are selected. The report focuses on two related practices: the exclusion of Black jurors through "death qualification" and the continued misuse of peremptory strikes despite constitutional protections under Batson v. Kentucky. By systemically barring Black community members from fully participating in jury service, death qualification violates the rights of both the accused and the prospective jurors alike.
