I've been absent for a good while, 4 years to be approximately exact!! LOL. For that I apologize. Since I've come back home to Florida things have been sort of rocky, but getting A LOT better quick.
After my release from the TDOC, I have 8 years of probation to contend with. The Tennessee Department of Corrections and the Tennessee judicial system have been doing as they please, making policy and rules (that actually have the effect of law) most of which are in direct contravention of the US constitution, their own state constitution, and even contrary to Tennessee statutes!!! They have gotten away with this unopposed for so long, they believe they can do anything to anyone in their custody with impunity. NOBODY contests any of the actions of the TDOC because when someone does complain, retribution is certain to follow and they WILL end up back in prison. NOT a good outcome, nor is it worth the struggle to most people. (That is a sad state of affairs, and will be the subject of another discussion we'll have here real soon)
After studying law and fighting my Pot case for over 3 years...I found out after my release that my legal battles with law enforcement were apparently going to be an ongoing struggle in order to force them to follow their own rules, regulations, and the law.
The FIRST THING the TDOC did was to try to "force" me into a cognitive behavior "class", and require my attendance 2 times per week for over a year. Nowhere in my plea agreement or final judgement was that a part of my sentence so I took their asses to court. I documented a bit of that struggle previously here. My position on the matter was solid, my research and case law were on point. The probation office I reported to got really pi**ed off at me for even having the temerity and go**ds, and for having the knowledge and the ability to sue them. I "sort of" complied with their "program" and attended the damned class until the date of the hearing on my motions. At first, I was laughed at, and was told I wouldn't win, that I was wasting my time, their time and the courts time with frivolous court filings (My P.O. even threatened, in not so many words, that I could be charged with filing frivolous suits.)
Yep! They were really worried! I was about to change how the TDOC would be handling probationers state wide!! The closer we got to our final hearing things were getting to the point that I could not even leave the house without getting arrested for some invented crime or probation condition violation!!! The TDOC was figuring out that I actually had a good chance of winning, so the retaliation commenced. They were going to violate my probation to keep me from winning the case at any cost.
Seeing the handwriting on the wall, I made plans to transfer my probation and move back home to S Florida. My transfer was approved so I made my travel arrangements and then waited for the final hearing on the whole TDOC thing. The hearing was scheduled for the day before my homeward departure flight. My flight was leaving Knoxville at 2:30 PM, but court in Crossville was at 9 that morning and I wasn't gonna miss that hearing for ANYTHING!! The TDOC and my Probation officer were evidently thinking I was gonna be so intent on getting out of Tennessee that I wouldn't show up. The look on their faces when I walked in was worth everything!!!
My case was called at around 10. I gathered my files and got ready to argue my case but to my dismay, the attorney the court appointed to me actually showed up and was already in front of the judge telling him that I was leaving the state and that my case was at that point moot! He agreed with her. I came UNGLUED on her after the judge dismissed my cases. The court HAD to give the TDOC and the Probation Dept. a way to "save face". I discovered that right, wrong or indifferent, In no way was I going to win that case at the trial court level. It was going to have to be fought in the appellate courts, and I wasn't sticking around for that!!!
The damned attorney stated that she wasn't going to argue my case because it was going to create bad law! I just looked at her with disgust, and asked " Bad Law? Bad for who exactly?" These Fu***ng lawyers!!! They call them Lawyers because "W***e" and "Liar" were already taken...
So in the end...I stayed out of jail and came home. I posted my motions, my research and my case law to several social media sites and made it all available to all probationers who were in the same situation with probation in Tennessee. At the end of the day I was able to come home, and left knowing that I left the state of Tennessee leaving the Tennessee Dept of Corrections licking their wounds. I take great satisfaction in that!!!
That about gets us caught up, I'll be posting a lot more regular from now on.
