It has recently been brought to the board’s attention that several violation notices were sent to homeowners for vehicles that were legally parked on the street. These violations were not authorized by the board, in fact, the board had specifically instructed PMI to not issue violation notices for this. PMI serves numerous communities, all with different rules and regulations. Sometimes, mistakes are made when issuing notices as what is against the rules in one community might not be in another.
On-street parking cannot be enforced in Hopewell Manor because of the public roadways and the way the CC&R is written. The HOA was asked about this a few years ago when the issue arose. The HOA attorney advised that since the roadways are public and the CC&R states that parking is prohibited on the taxpayer-funded streets the HOA cannot enforce on-street parking. However, if the CC&R stated all vehicles must be parked on a driveway or in a garage the rule would be able to be enforced since the violation would be given for where the vehicle wasn’t parked (homeowner’s private property) as opposed to where it was parked (public roadway). We know it comes down to semantics, but that is what we are forced to go by. With that being said the board asks everyone to be cognizant of safety when parking on the street, especially at intersections and bus stops.
PMI has been instructed to close out any violations that were issued for merely parking on the street. They have also been instructed to stop issuing notices to vehicles legally parked on the street and to only issue violation notices for the following:
1. Unauthorized and/or inoperable vehicles
2. Parking on the sidewalk
3. Parking in the driveway, but sticking out and into the sidewalk
4. Parking on your front yard
