The Colorado Parks and Wildlife Commission's vote this week was not wildlife management. It was capitulation.

By a 6-5 margin, commissioners rejected their own staff's data-driven recommendation of a 15-animal daily bag limit and instead imposed a limit of two — a decision made possible only by three newly appointed commissioners who have not yet been confirmed by the Colorado Senate, one of them casting a vote in her very first meeting on the board.

What makes this indefensible is not the outcome alone, but the record CPW put in front of the commission before the vote. Deputy assistant director Matt Eckert testified that harvest levels across furbearer species are at historic lows, that beaver populations statewide sit at roughly 53,000, and that observed take represents "a small percentage of the maximum allowable harvest for a sustainable population."

None of that mattered. Commissioner Becky Niemiec made it clear he role on the Comission is to advance her ideology: the point of the new limit was "to make sure people feel better" about trapping — not to correct any biological problem. She backed that position with a self-run, unverified survey of fewer than 700 respondents, which CPW's own staff noted had not been independently validated, against harvest data the agency called its "gold standard."

This is what happens when a wildlife commission stops managing wildlife and starts managing perception. Commissioner Tai Jacober warned the board should lean toward science over social tolerance; he was outvoted. Commissioner Frances Silva Blayney argued the state has no furbearer problem to solve; she was outvoted. Even Commissioner Jack Murphy, who backed a compromise limit, conceded trappers have "very little impact because there's just not many of them" — which only underscores how unnecessary this proposal was.

This is a historic moment for Colorado.

The Right to Hunt and Fish is about protecting the opportunity to hunt and fish in this state. It does not erase regulations. It does not remove licensing. It does not change private property laws. It does not give anyone a free pass.

For the individual, hunting and fishing remain regulated, licensed, and accountable.

But the opportunity itself deserves protection.

Colorado has been ground zero for ballot-box wildlife politics. Today, we turned a page.

For years, we’ve asked when hunters, anglers, organizations, brands, creators, guides, outfitters, and everyday citizens would stop only playing defense and start building something proactive.

This is it.

This is the moment.

This is the work.

This is our generation’s chance to build something that lasts beyond us.

Colorado is the beginning. The West is watching.

And future generations may look back at these boxes and understand exactly what they represented:

A movement deciding it was time to protect the future.

Be it enacted by the People of the State of Colorado:

SECTION 1. In the constitution of the state of Colorado, add Section 13 to article XVIII as follows:

Section 13. Right to fish and hunt.

(1) THERE IS ESTABLISHED A RIGHT OF THE PEOPLE OF COLORADO TO HUNT, FISH, AND TAKE FISH AND WILDLIFE. THE RIGHT INCLUDES HUNTING, FISHING, AND HARVESTING FISH AND WILDLIFE BY THE USE OF TRADITIONAL METHODS. THE RIGHT APPLIES TO ALL SPECIES OF FISH AND WILDLIFE MANAGED BY THE STATE EXCEPT NONGAME SPECIES, ENDANGERED SPECIES, OR ANY SPECIES THAT IS ILLEGAL TO HUNT UNDER FEDERAL LAW.

(2) THE POLICY OF THE STATE OF COLORADO IS THAT HUNTING AND FISHING ARE THE PREFERRED MEANS OF RESPONSIBLY MANAGING FISH AND WILDLIFE POPULATIONS.

(3) THIS SECTION IS NOT INTENDED TO AUTHORIZE TRESPASS UPON PRIVATE PROPERTY OR TO MODIFY ANY PROVISION OF STATUTES RELATING TO TRESPASS OR PROPERTY RIGHTS.

(4) THIS SECTION DOES NOT LIMIT THE AUTHORITY OF AN AGENCY OF THE STATE OF COLORADO OR THE GENERAL ASSEMBLY TO REGULATE HUNTING, FISHING, AND WILDLIFE MANAGEMENT IF THE LAW IS NECESSARY FOR SOUND SCIENTIFIC WILDLIFE CONSERVATION AND MANAGEMENT, PUBLIC SAFETY, OR TO PRESERVE THE FUTURE OF HUNTING AND FISHING OPPORTUNITIES FOR ALL SPECIES STATEWIDE.
