Homelessness Is Not a Crime.
In May 2026, a Jefferson County judge challenged the constitutionality of Kentucky's unlawful camping law (HB 5), raising concerns about whether criminal penalties are an appropriate response to homelessness.
The conversation is especially important as communities across Kentucky continue to face a shortage of emergency shelter beds, affordable housing, and supportive services. Here in Northern Kentucky, recent housing studies have highlighted the growing gap between incomes and available housing options, while homelessness remains a year-round challenge.
When shelter is unavailable and housing is out of reach, citations and criminal penalties do not create housing, increase income, or address the underlying causes of homelessness. Real solutions require investments in emergency shelter, affordable housing, workforce development, behavioral health services, and pathways to self-sufficiency.
