IMPORTANT NOTICE:
Special Meeting of the Bridlewood Estates Homeowners Association
Dear Bridlewood Estates Homeowner,
You will be receiving a hardcopy of the letter below along with a proxy in your mailbox, likely next week. Should you be unable to attend the meeting to vote in person, please be sure to complete your proxy and hand it to a neighbor who is attending or please email the board and we can come pick it up from you in person.
The Bridlewood Estates HOA Board of Directors is calling a Special Meeting of the Membership to discuss an important matter affecting our community and to request your attendance and a vote on a proposed amendment to the Association's governing documents.
This issue involves the brick entrance wall along Brown Trail (discussed at annual meeting), which is owned and maintained by the Association. Over time, the wall has sustained significant structural damage and continues to lean due to the root systems of mature trees located behind the wall. The condition of the wall has reached a point where it represents a potential safety hazard and liability for our community and members.
As part of our due diligence, the Board has obtained three independent contractor estimates to evaluate repair options. The contractor the HOA has used for the past nearly two decades will not bid the job unless the two trees are removed, so we do not have an estimate from them. The issue has arisen as to the association’s liability for the removal or damage to trees or other landscaping during the contractor recommended work to remedy the situation. Unfortunately, the homeowner whose property contains the trees does not wish to have them removed or their roots cut in order to prevent further potential damage to the walls, and the governing documents are unclear as to whether the HOA has the authority to move the trees or cut the roots without potential liability to the HOA.
The Board fully understands and respects the homeowners’ desire to preserve the trees. At the same time, we have a fiduciary responsibility to protect the Association and all homeowners from the significant liability posed by a failing masonry wall. The board would like to have the members input into the situation and how the board will handle it moving forward.
After careful consideration, the Board believes the most responsible course of action is to remove the existing damaged wall, eliminate the immediate safety risk, and install a temporary replacement until a permanent solution can be implemented. However, before this option can move forward, the Association's governing documents must be amended to provide the authority necessary to complete this work while protecting the Association from potential liability related to the adjacent trees.
At the Special Meeting, the Board will:
Present the history of the Brown Trail entrance wall issue.
Share the contractor findings, including the three repair estimates.
Explain why the current situation presents a liability to the Association.
Review the proposed amendment to the Association's governing documents
Answer homeowner questions and ask for input on the path forward
Request a vote on the proposed amendment to the HOA’s governing documents.
Your participation is critical.
Under our governing documents, the proposed amendment requires approval from at least 51% of the Association's homeowners, either by attending the meeting in person or by submitting a valid proxy, which will be mailed to you. Without this level of participation and approval, the Association's ability to address this safety concern will remain unclear.
This decision will have a lasting impact on our neighborhood, and we encourage every homeowner to become informed before casting a vote. We respectfully ask that you make every effort to attend the meeting or, if you are unable to attend, complete and return the enclosed proxy so your vote can be counted.
