What this means for you - and what it doesn't mean (most important)

Over Mother's Day weekend, the Trump administration proposed a new rule that would allow employers to offer fertility benefits as a standalone "excepted benefit" — similar to dental and vision coverage.

The headlines sound promising. But before you assume your fertility care costs are about to be covered, INCIID wants you to have the complete picture.

Here is what the proposal would do — and what it would NOT do:
✅ Employers COULD voluntarily offer standalone fertility coverage
✅ Workers could enroll without joining their employer's main health plan
✅ Coverage could include IVF, diagnostics, medications, and more

❌ No employer is REQUIRED to offer it — it is entirely voluntary
❌ A $120,000 lifetime cap may sound like a lot — until you do the math on actual IVF costs

❌ ACA consumer protections would NOT apply
❌ If you already HAVE fertility benefits, your employer could switch to this cheaper structure and REDUCE your coverage
That last point is one nobody else is talking about. INCIID is raising it — and we will be submitting formal public comments when the 60-day comment period opens.
