Is the future of artistic expression at stake? The Supreme Court will consider whether Andy Warhol's Prince paintings violate copyright law.
In The Andy Warhol foundation for the Visual Arts Inc. v. Goldsmith, Lynn Goldsmith is seeking remedy for the infringement of her photo. Shot in 1981, Vanity Fair magazine licensed Goldsmith's photo for a portrait as an "artist's reference". Lynn Goldsmith, however, thinks that this is not just a reference.
The Supreme Court will have to put on their art critic hats and answer some big questions for fair use in copyright law in the upcoming case.
