Emotional Support Animals VS Service Dogs

Emotional Support Animals (ESA) provide emotional support for their owners and are considered as pets. They must be prescribed by a doctor or licensed mental health professional. *ESA’s do NOT have public access rights.* They are only protected under the Fair Housing Act (FHA), giving them the legal right to live with their owner in non-pet friendly housing. They are exempt from pet fees, breed restrictions, and pet bans. They can be any age and any breed. As of January 2021, ESA’s are no longer protected under the Air Carrier Access Act (ACAA) and are now required to fly as pets.

Service Dogs are specially task-trained with at least one task to help mitigate their handlers disability. They are considered medical equipment. *Service dogs are protected under the Americans with Disabilities Act (ADA), giving them legal public access rights to accompany their handler into any public space.* Public spaces include stores, restaurants, hotels, airbnb’s, ubers/rental cars, and more. Handlers cannot be charged pet fees and there are no breed restrictions. Service dogs are also protected by the Air Carrier Access Act (ACAA) and are allowed to accompany their handlers onto flights. Service dogs can be owner trained or trained by an organization. In the United States, there is no “certificate” or “registration” for service dogs.

-Around the world, 1 in 3 women has experienced domestic violence.
-Nearly 1 in 5 teenage girls in relationships said a boyfriend has threatened violence or self-harm when presented with a breakup.

Why It Matters

30% of survivors experience PTSD. Emotional support animals and service dogs are able to mitigate symptoms of PTSD, as well as decrease feelings of loneliness and isolation. Owning a dog can also give survivors a renewed sense of purpose.
Through our own experiences, we have learned that survivors of sexual assault and domestic violence can greatly benefit from emotional support animals and service dogs.
