The Charleston Beach Foundation is pleased to announce that Bill S.40 has now received its Third Reading and approval in the SC House of Representatives, and will be sent on to the Governor for signature to be enacted into law!โฃ
โฃ
This is a win for all citizens of the State of South Carolina as it is now clear that SCDOT has final approval authority over any restrictions (including parking fees) a beach municipality may wish to impose on parking facilities on state roadways.โฃ
โฃ
Additionally, it reaffirms that obstructions on state highway right of ways, including shoulders and parking areas, are unlawful, and provides fines of $100 a day and/or imprisonment for up to thirty days for those who violate the law.โฃ
โฃ
This law is also a win for the beach municipalities and its residents as it allows for parking revenues to be used not only to fund installation and maintenance of public beach parking facilities, but also to fund additional expenses such as beach access, maintenance and renourishment; traffic and parking enforcement; first responders; sanitation; and litter control and removal for beaches.โฃ
โฃ
We have full trust and faith in SCDOT that it will enforce this law which will ensure that everyone will be able to afford a day at the beach, and that there will be parking available to the general public on our state roadways that provide access to the beach.โฃ

Our thanks go out to Senator Larry Grooms (the Sponsor of the Bill), Secretary of Transportation Christy Hall and her team at SCDOT, along with Senator Sean Bennett, Representative Mark Smith, and the many supporters of the Bill in both the Senate and the House who helped to push this Bill through the long, arduous path to becoming law.ย ย โฃ

If it is not reached Thursday, it should come up to bat next week, and will most-likely be fully-addressed before this session ends on May 13th.โฃ
