𝗟𝗘𝗚𝗜𝗦𝗟𝗔𝗧𝗜𝗩𝗘 𝗨𝗣𝗗𝗔𝗧𝗘. Beach Bill S.40 is now law. The people have spoken. ⁣We did it! 👏👏
⁣

The Charleston Beach Foundation is pleased to announce that Bill S.40 has now received its Third Reading and approval in the SC House of Representatives, and will be sent on to the Governor for signature to be enacted into law!⁣
⁣
This is a win for all citizens of the State of South Carolina as it is now clear that SCDOT has final approval authority over any restrictions (including parking fees) a beach municipality may wish to impose on parking facilities on state roadways.⁣
⁣
Additionally, it reaffirms that obstructions on state highway right of ways, including shoulders and parking areas, are unlawful, and provides fines of $100 a day and/or imprisonment for up to thirty days for those who violate the law.⁣
⁣
This law is also a win for the beach municipalities and its residents as it allows for parking revenues to be used not only to fund installation and maintenance of public beach parking facilities, but also to fund additional expenses such as beach access, maintenance and renourishment; traffic and parking enforcement; first responders; sanitation; and litter control and removal for beaches.⁣
⁣
We have full trust and faith in SCDOT that it will enforce this law which will ensure that everyone will be able to afford a day at the beach, and that there will be parking available to the general public on our state roadways that provide access to the beach.⁣
⁣
Our thanks go out to Senator Larry Grooms (the Sponsor of the Bill), Secretary of Transportation Christy Hall and her team at SCDOT, along with Senator Sean Bennett, Representative Mark Smith, and the many supporters of the Bill in both the Senate and the House who helped to push this Bill through the long, arduous path to becoming law. ⁣
⁣
The Charleston Beach Foundation will continue its other efforts to provide additional reasonable access to beach parking for non-island residents, and to address excessive parking fees and fines on our local beach towns.⁣

𝗧𝗵𝗲 𝗛𝗼𝘂𝘀𝗲 𝗼𝗳 𝗥𝗲𝗽𝗿𝗲𝘀𝗲𝗻𝘁𝗮𝘁𝗶𝘃𝗲𝘀 𝘃𝗼𝘁𝗲 𝗼𝗻 𝗦.𝟰𝟬. 👏⁣ On to the 3rd reading tomorrow, then the next step is signature by Governor McMaster!⁣
⁣
Representative Mark Smith made a powerful speech highlighting that Bill S.40 effects everyone in the state, and emphasizing the resolutions requesting adoption of the Bill by the Town of Mount Pleasant, City of North Charleston, and the Counties of Charleston, Dorchester, Berkeley and Georgetown.⁣
⁣
Representative Adam Morgan from Taylors presented the Bill and our local guy Mark M. Smith tied it all up in a bow. Thank you, Mark Smith!⁣

𝗕𝗶𝗹𝗹 𝗦.𝟰𝟬 𝗨𝗣𝗗𝗔𝗧𝗘: The House has adjourned until Tuesday, May 11th at noon, and the Bill was not reached for debate this week.⁣
⁣
The Speaker of the House did say that he expects all bills (including Bill S.40) to be debated and addressed before the session ends on May 13th. ⁣
⁣
Now we sit and wait. ⁣
⁣
There is no need to send any further communications to the Members of the House. They have received enough emails and calls, and thank you to everyone who did send those emails and make those calls. ⁣
⁣
If all goes well, the debate should happen on May 11th at the 2nd reading, followed by a 3rd reading the next day, and passage by the House. ⁣
⁣
As Tom Petty said, “the waiting is the hardest part.”⁣

These Resolutions reflect that the issue of reasonable parking to access to public beaches and waters is vitally important to the approximately 900,000 citizens of the Lowcountry, as well as every other resident of the State of South Carolina.⁣

𝗨𝗣𝗗𝗔𝗧𝗘 𝗢𝗡 𝗕𝗜𝗟𝗟 𝗦.𝟰𝟬: Twenty-Two (22) Representatives out of the total 124 members requested debate on Bill S.40 today.⁣
⁣
The Bill is included on the calendar for Thursday April 29th, under "Second Reading Statewide Contested Bills," however, it may not be reached for debate Thursday. If it is not reached Thursday, it should come up to bat next week, and will most-likely be fully-addressed before this session ends on May 13th.⁣
⁣
The Representatives requesting debate include Charleston Delegation Members Mark M. Smith, Leon Stavrinakis, Deon Tedder, Spencer Wetmore, and Joe Bustos.⁣
⁣
Other Reps. include Adam Morgan and Merita Allison who voted in favor in Committee; and Jerry Carter, Ryan McCabe, RJ May, Melissa Oremus, Timothy McGinnis, Brandon Newton, Russell Ott, Carl Anderson, Max Hyde, Travis Moore, Roger Nutt and Roger Kirby, all of whom we hope are supportive.⁣
