Howard Fischer has an excellent 600-word explanation of the 9th Circuit Court's recent SunZia decision in the Arizona Capitol Times.

The Tohono O'odham Nation has a new chance to argue that federal officials broke the law in allowing the construction of a power line in the San Pedro Valley.

"Appeals court revives Native American challenge to $10B SunZia energy transmission project," from the Associated Press.

A federal appeals court has sided with Native American tribes in their fight against the federal government over a $10 billion energy transmission line that will carry wind-generated electricity from New Mexico to customers as far away as California.

The 9th Circuit Court sided with two tribes and two nonprofits opposing the SunZia transmission line through the middle San Pedro Valley. The Court agreed that the plaintiffs have grounds to claim that the Dept. of Interior violated the National Historic Preservation Act by failing to evaluate whether the Valley should be designated as a historic property. The court reversed and remanded the District Court's decision.

We did our best at the Commission to stop the Corporation Commission approval of SunZia but lost 3-2. We're unsure where to do from here at the moment. Here's the story from the Benson Sun-News: "SunZia gets ACC OK," http://www.bensonnews-sun.com/news/article_0382338a-cf5b-11e5-98c1-43b1b7be0d55.html

SunZia received Arizona Corporation Commission (ACC) approval last week for its proposed extra-high voltage transmission project, spanning about 500 miles between Arizona and New Mexico.

From Sierra Club:

"The proposed SunZia Southwest Transmission Project would march from New Mexico across southern Arizona, causing irreparable harm to Arizona's natural and cultural resources. This project, which would include two 500-kV transmission lines, would create one of the largest new utility corridors in the western U.S. Its path through the lower San Pedro Valley and through other public lands would negatively affect wildlife habitat and movement corridors, cultural sites, the river itself, and more.

The San Pedro Valley, known for its rich riparian habitat and diverse wildlife, has been the focus of major federal, state, and corporate conservation efforts for four decades. The proposed corridor would negate many of these efforts. The need for the project is also highly questionable as similar, yet less damaging, projects have also been proposed that would accomplish the stated objectives.

The Arizona Corporation Commission (ACC) will be meeting on February 2, 2016, no earlier than 1 p.m., to consider granting a Certificate of Environmental Compatibility to this project. This would be the last step for SunZia. Please attend if you can and also send a message to the ACC!"
