The Susan Muffley Act has been introduced in the U.S. Senate as S. 1950!

In a news release today, it was announced that Senator Jon Husted (R-OH), Senator Kirsten Gillibrand (D-NY), Senator Bernie Moreno (R-OH), and Senator Gary Peters (D-MI) introduced the Susan Muffley Act in the U.S. Senate. Cosponsoring the bill are Senators Roger Wicker (R-MS), John Fetterman (D-PA) and Tammy Baldwin (D-WI).

We are very appreciative of the work these senators have put into this legislation and look forward to working with them to get it passed in the Senate.

(Info * April 3) TO RECAP, HERE ARE THE TWO, RECENTLY INTRODUCED BILLS:

H.R.1357 — introduced by Rep. Mike Turner (R-Dayton) as the Susan Muffley Act 2025, it uses funds from our pension plan’s appreciated assets since 2009 to pay retirees their full, earned benefits. The bill calls for drawing any additional needed funds from the general fund, but this can be offset during the legislative process as Congress often does.

H.R.1895 — introduced by Rep. Victoria Spartz (R-Kokomo/Anderson) -- also uses funds from our pension plan’s appreciated assets since 2009 to pay retirees their full, earned benefits. If necessary, the PBGC can draw additional funds from its massive and growing surplus (more than $50 billion today; estimated by PBGC to be $70 billion in 2033).

Their approaches differ somewhat, but passage of either would restore our full benefits and should be supported.

(Info * March 6) Rep. Victoria Spartz (R IN) and 13 of her House colleagues today introduced H.R. 1895, the Delphi Retirees Pension Restoration Act. It is bipartisan legislation to fully restore our Delphi Salaried Retirement Plan. Her press release said in part: "This bill restores retirement benefits for thousands of hard-working Americans wronged by the politics of an auto-industry bailout in 2009 with no fiscal impact to the taxpayers. This issue has not been resolved for too long, and I appreciate the bipartisan support to finally bring justice for so many people around the country.”

Congresswoman Spartz's original cosponsors include Reps. Turner (R OH 10), Rulli (R OH 6), Scott (R GA 8), Langworthy (R NY 23), Thanedar (D MI 13), Tlaib (D MI 12), Tenney (R NY 24), Stutzman (R IN 3), LaMalfa (R CA 1), Wilson (R SC 2), Hamadeh (R AZ 8), Kaptur (D OH 9) and Carson (D IN 7).

This bill is in addition to the reintroduction of the Susan Muffley Act by Rep. Mike Turner (R OH) in February. Constituents of Rep. Spartz's original cosponsors are encouraged to thank them for signing on so early.

REP. TURNER REINTRODUCES BILL TO RESTORE DELPHI SALARIED RETIREES' PENSIONS

WASHINGTON, D.C. – Today, Congressman Mike Turner (OH-10) joined representatives Marcy Kaptur (OH-09), Claudia Tenney (NY-24), and Gwen Moore (WI-04) to reintroduce the Susan Muffley Act of 2025.

This bipartisan effort is aimed at restoring pensions for over 21,000 Delphi Salaried Retirees, including approximately 5,180 in Ohio. Named in honor of the late wife of a Delphi retiree, the legislation seeks to provide financial relief to those whose pensions were reduced or eliminated following Delphi’s bankruptcy.

“I have remained steadfast in my fight to restore the pensions of Delphi Salaried Retirees,” said Congressman Mike Turner. “While this has been a long time coming, the strong bipartisan support gives us hope that we can finally right this wrong for those who lost their pensions.”

“The dedicated men and women who contributed to Delphi's success were assured a secure retirement as a reward for their years of commitment,” said Congresswoman Kaptur. “Yet, time and again, we’ve seen how these solemn promises to American workers have been discarded, stripping them of financial stability that is justly theirs. The re-introduction of the Susan Muffley Act underscores our commitment to fulfilling Delphi’s initial promise. By reinstating earned retirement benefits, we ensure a brighter future for thousands of retirees. From Defiance to Sandusky, Ohio, and throughout the Midwest and Industrial Heartland, the Susan Muffley Act is crucial to restoring what these retirees are owed.”

“In 2009, the Obama administration unjustly stripped over 20,000 Delphi workers of their hard-earned pensions,” said Congresswoman Tenney. “For nearly 14 years, the Delphi Salaried Retirees have been fighting to reclaim the full benefits they lost through no fault of their own. I am honored to once again lead the Susan Muffley Act, which seeks to correct this grave injustice by restoring the pensions of all Delphi Salaried Retirees, including the 2,300 impacted in Western and Central New York.”

“It’s past overdue for Delphi salaried workers to be made whole through the restoration of their pensions,” said Congresswoman Moore. “That’s why I am proudly joining this important bipartisan effort to ensure these workers receive the retirement benefits they have earned and deserve.”

Congressman Turner and the three co-leads were joined by a bipartisan coalition of original cosponsors including Daniel Webster (FL-11), Adam Smith (WA-09), Michael Rulli (OH-06), Austin Scott (GA-08), Jim Baird (IN-04), Jack Bergman (MI-01), Shri Thanedar (MI-13), Troy Balderson (OH-12), Brian Steil (WI-01), Mark Pocan (WI-02), Dave Joyce (OH-14), Kristen McDonald Rivet (MI-08), and Victoria Spartz (IN-05).

Under the bill, retirees would receive a lump sum payment covering the pension benefits they should have received over the past 15 years, with 6 percent interest added to account for the delay. Moving forward, the legislation would fully restore their pensions, ensuring retirees receive the payments they were originally promised, as if the disruption had never occurred.

Background:

During the Great Recession of 2009, car parts manufacturer Delphi faced bankruptcy. The company was acquired by General Motors (GM), which also faced financial hardship during that time. As part of GM’s bailout, the Pension Benefit Guaranty Corporation (PBGC) took trusteeship of Delphi employees’ pensions at the direction of the Obama Administration.

One group employed by Delphi was a group of 21,000 salaried employees, including those who worked at the company’s plant in Dayton. Retirement benefits for these employees included a single-employer pension. GM decided to close the plant and voluntarily terminate the fully funded pension of the salaried employees. At that point, the PBGC became the sole trustee of the plan. The salaried employees then formed the Delphi Salaried Retirees Association (DSRA).

Since 2009, Congressman Turner has been working closely with the Delphi Salaried Retiree Association (DRSA) to restore their benefits throughout the Obama, Trump and Biden Administrations.

In October 2020, at the urging of Congressman Turner, former President Trump signed a Presidential Memorandum directing the PBGC to examine the financial status of Delphi Salaried Retirees’ pension fund and to investigate administrative or legislative pathways for the restoration of the fund.

In December 2021, Turner filed an Amicus Brief when the DSRA filed for Cert with the U.S. Supreme Court in the Dennis Black, et al. v. PBGC case. The case was subsequently denied cert, thus Turner authored the “Susan Muffley Act” as the only option to wholly restore the pensions.

In July 2022, the Susan Muffley Act passed the House of Representatives with bipartisan support 254-175. Unfortunately, the Senate failed to approve the bill prior to the end of the 117th Congress.

CONTINUING TO FIGHT TO RESTORE OUR PENSIONS IN 2025

Our fight to restore the full pensions of all Delphi salaried retirees continues into 2025. Having concluded meetings with our congressional advocates, we believe that the new political landscape in Washington in 2025 affords us the best chance ever of achieving success, although we still have an uphill fight.

Some of our staunch supporters departed from Congress at the end of 2024 — We are most appreciative of the support and efforts of Rep. Dan Kildee (D-MI), Sen. Sherrod Brown (D-OH), and Sen. Mike Braun (R-IN). We almost achieved passage, but they simply couldn’t overcome the circumstances that blocked us.

Things appear encouragingly different in 2025. We are encouraged and determined to continue the fight to restore the Delphi Salaried Retirement Plan.

The facts are that the plan was wrongly terminated in 2009 solely because the Federal Government chose to interject itself into the General Motors (GM) bankruptcy process. In an unprecedented circumstance, the Government chose to invest $50 billion of taxpayer money to purchase GM — pundits nicknamed the new company "Government Motors." However, our employer, auto parts-maker Delphi Corporation — GM's biggest supplier — was nearing the end of a several year effort to restructure, taking many difficult steps to jettison unprofitable business lines in order to compete. What was left was a strong company that drew the attention of several potential investors.

Delphi's timetable for exiting bankruptcy did not align with the Government's 40-day timetable for GM's emergence from bankruptcy — So, the Pension Benefit Guaranty Corporation (PBGC) abandoned its earlier efforts to preserve Delphi's traditionally well-funded pension plan for salaried employees and took over the pension plan in mid-2009 without seeking Federal Court approval. Delphi's savvy bankruptcy lenders from Wall Street then quickly bought Delphi out of bankruptcy, and , true to their nature, reaped huge profits just a few years later by selling off Delphi's remaining, strong business lines to other companies — while leaving Delphi salaried retirees with drastically reduced pensions.

The federal government broke a viable pension plan that would be paying full benefits to Delphi salaried retirees today IF government had not created this unique and unprecedented termination:

Government broke it – it's the government's responsibility to fix it.

We look forward to working with the legislative supporters we gained last year to carry us forward in the new Congress to the full restoration of the pensions that we earned.

(Info - Aug. 17) The Congressional Research Service (CRS), which provides reports to help guide Congress, issued a "Summary of the Employee Retirement Income Security Act," in May of 2009. This Federal Law -- passed by Congress in 1974 -- is often referred to as ERISA. Its provisions include creating the Pension Benefit Guaranty Corp (PBGC). The CRS report says this on page 32: "One of the primary goals in enacting ERISA was to 'protect ... the interests of participants and ... beneficiaries' of employee benefit plans, and assure that participants receive promised benefits from their employers." ERISA § 2, 29 U.S.C. § 1001

The PBGC clearly ignored this purpose when it stopped seeking to preserve our pension plan once the Obama-Biden Administration formed an ad hoc Auto Team under the U.S. Treasury Department -- for the purpose of saving GM and the U.S. auto industry in general. It was an understandable goal, but we were thrown under the bus!

Between 2009 and 2013, Congress has held hearings seven times to scrutinize the circumstances surrounding the termination of the Delphi salaried pension plan in 2009 and how it got drawn into the U.S. Government's direction of the General Motors 40-day bankruptcy that year.
