၁။ ဘယ်အချိန် Green Card စလျှောက်လို့ရလဲ?
Asylum granted ရပြီးတနှစ်အတိပြည့်ရမယ်။ U.S. ထဲမှာ အနည်းဆုံး ၁ နှစ် physically present ရှိရမယ်။
ဒါဆိုတင်လို့ရပါပြီ။

♦️I-485 နဲ့တွဲတင်ရမည့် အဓိကစာရွက်တွေကအရေးကြီးပါတယ်။
စာမျက်နှာ၂၀ကျော်တဲ့ဒီဖောင်ကအသက်နော် တကွက်မှချန်လို့မရဘူး ။
လာပြီ ဒုတိယ Form I-693 —
Medical examination and vaccination record. USCIS က 2024 Dec. 2 မှစပြီး I-485 တင်သူများသည် I-693 ကို I-485 နဲ့အတူ တင်ရမယ်လိုထုတ်ပြန်ထားပါတယ်။
ဒါလဲလိုပါတယ်။
Form G-1145 — Text/email receipt notice ရချင်ရင် ထည့်ရမယ်။
Form I-912 — Fee waiver လျှောက်ချင်ရင် ထည့်ပါ။ USCIS fee schedule မှာ fee-exempt category တွေကို $0 ဟုဖော်ပြထားပြီး fee information ကို Form G-1055 မှာ verify လုပ်ရမယ်လို့ USCIS ပြောထားပါတယ်။ မေတ္တာမေမေကတော့မလုပ်စေချင်ဘူး။

✅A/-အထာက်ထားတွေလာပြီ။
Identity / Immigration Proof
Asylum approval proof — USCIS asylum approval letter သို့မဟုတ် Immigration Judge order.
I-94 showing asylee status — asylum granted I-94.
Passport copy — biographic page, visa page, U.S. entry stamp ပါလျှင်.
Government-issued photo ID — passport, state ID, EAD.
EAD copy — asylee EAD ရှိလျှင်.ထည့်။

♦️B/-လာပီုအရေးကြီးဆုံးစာရွက်တွေ။
Birth certificate — asylee/refugee cases မှာ birth certificate မရှိလျှင် ပြသာနာပါ။USCIS checklist မှာ I-485 applicants အတွက် identity document, photos, eligibility evidence စတာတွေအကုန်ပါရမှာနော်။အရိပ်တကြည့်ကြည့်နဲ့မွေးလာရတာ။အတိကျလုပ်ရမယ်။

💢C. 1-Year Physical Presence Proofဒါကတော်တော်အရေးကြီးတယ် ။

Asylum အောင်ပြီးနောက်ပိုင်း U.S. ထဲမှာ ၁ နှစ်ရှိနေခဲ့ကြောင်း သက်သေပြရမယ်။
ဥပမာ—
lease / rent letter, utility bills, bank statements, pay stubs, W-2, tax return, school records, medical records, insurance, phone bills, letters received at address.ဒါဆိုရပါပြီကွယ်
one-year physical presence evidence အဖြစ် lease, paystubs, school records, bills တွေပြရသ်ရပြီ ။

D. Photos
Passport-style photos 2 ပုံ ကိုတင်ခါနီးနားရွင်ထော်ရိုက်ထားပါ။

E. If derivative asylee ဖြစ်လျှင်
ဒါကတော့အောင်သူရဲ့ဇနီးမယားကလေးတွေဆိုရင်
marriage certificate, birth certificate, I-730 approval, principal asylee approval proof, relationship proof တွေလိုပါမယ်။

ဒါပေမဲ့Asylum အောင်လို့Green Card လျှောက်သူအတွက် sponsor income / I-864 မလိုပါ။ Food stamp, Medicaid တချို့ရထားပြီးsponsor မရှိလို့ဆိုပြီး ပုံမှန် family-based green card လိုမျိုး public charge ကြောင်မစိုးရိမ်ပါနဲ့။(အေးလေမစိုးရိမ်နဲ့ဆိုပေမဲ့ အရာရာကအမျ်ုးဆိုတောလဲ ! အင်းပေါ့)

ကုန်ကျငွေ ဘယ်လောက်ပါလိမ့်?
လက်ရှိ fee schedule G-1055 မှာ $1,440 လို့ဖော်ပြထားပါတယ်ဆေးစစ်တာက$600လောက်ရှေ့နေခ$၃၀၀၀ လောက်
အကြမ်းမျဉ်းမှတ်ထားပါ Attorney မပါဘဲ ကိုယ်တိုင်တင်လျှင် medical အပါအဝင် စုစုပေါင်း $1,750–$2,400 ခန့် ကြိုတွက်ပါ။

လာပြီနော်။အရေးကြီးစာရွက်များစစုပါ ။Checklistများ

၁-Asylum proof — asylum approval letter / IJ order, I-94 asylee.
၂-Identity — passport, EAD, state ID.
၃/1-year proof — lease, bills, bank, paystubs, tax, school, medical records.
၄-Medical — civil surgeon I-693 sealed envelope or USCIS-required submission.
၅-Photos — passport photo 2 ပုံ.
Birth certificate — ရှိလျှင် translation နဲ့.
၆/Any arrests/criminal record — ရှိလျှင် court disposition
၇-Travel history — asylum အောင်ပြီးနောက် U.S. ပြင်ပထွက်ဖူးလား စစ်ပါ.
၈-Address history — I-485 မှာ ဖြည့်ရန်.
၉-Employment history — I-485 မှာ သေချာဖြည့်ပါ

၆။ အရေးကြီး သတိထားရန်
Asylum အောင်ပြီး Green Card မတင်ခင် အောက်ပါအချက်တွေကို စစ်ပါ။

⁉️၁/-ကိုယ့်တိုင်းပြည်ကို ပြန်သွားဖူးလား —
ကွိုင်ပြီ။Asylum claim နဲ့ contradiction ဖြစ်နိုင်ပါတယ်။
၂/-Refugee Travel Document မပါဘဲ U.S. ပြင်ပထွက်ဖူးလား — risk ရှိနိုင်ပါတယ်။
၃/-Criminal record ရှိလား — petty offense တောင် court disposition လိုပါတယ်။
၄/-Asylum story fraud / inconsistency ရှိလား — I-485 မှာ USCIS က asylum grant ကို ပြန်ကြည့်နိုင်ပါတယ်။ဒါအရေးကြီးဆံုးနော်။စီတီဇင်၁၀နှစ်ရထားသူက၁၀နှစ်ကျော်မှ”ပြန်”ရတာတွေရှိပါတယ်။
၅/-One-year physical presence proof ပြည့်ရဲ့လား — လိုလာ ရင် RFE ထွက်နိုင်ပါတယ်။
ကဲဒါဆိရင်မေတ္တာက၂၀၂၅အောငိထားတဲ့ကလေးတွေကိုယ်တိုင်တင်မယ်ဆိရင်တောင်ခေါ်မေးကြပါနော်။
မင်းတို့ပျော်တာထက်မေတ္တာမေမေပိုပျော်ရပါတယ်။ယုံပါ။

🔥 Travel Ban ဖျက်လိုက်တာ မဟုတ်ပါ။
🔥 သင့် case အလိုအလျောက် approve ဖြစ်မယ်လို့လည်း မဆိုလိုပါ။

✅မေတ္တာအနေဖြင့် followers ရဖို့ထက်၊ လူထုအတွက် “မှန်ကန်တဲ့သတင်း၊ တိကျတဲ့အဓိပ္ပါယ်၊ လက်တွေ့လုပ်ရမယ့်အချက်”များ ကိုသာ မျှဝေလိုပါသည်။

💢“ဇွန်လ ၅ ရက်၊ ၂၀၂၆ တွင် ဖက်ဒရယ်တရားသူကြီး John J. McConnell Jr. က USCIS ၏ case hold/freeze မူဝါဒအချို့ကို တရားမဝင်ကြောင်း ဆုံးဖြတ်ခဲ့ပါသည်။

👍သတင်းများအရ အဆိုပါမူဝါဒများကြောင့်
Travel Ban နှင့်ဆက်စပ်သော နိုင်ငံ ၃၉ နိုင်ငံမှ လူများ၏ asylum, work permit/EAD, green card, citizenship စသည့် USCIS applications များကို အဆုံးမရှိ ဆိုင်းငံ့ထားခြင်းများ ဖြစ်ခဲ့သည်ဟု ဖော်ပြထားပါသည်။

✅တကယ်နားလည်ဖို့က-
ဤအမိန့်သည် Travel Ban ကို ပယ်ဖျက်လိုက်ခြင်း မဟုတ်ပါ။
ဤအမိန့်သည် USCIS က nationality / travel-ban country အကြောင်းပြပြီး အမှုတွဲများကို အဆုံးမရှိ hold လုပ်ထားခြင်းကို တားမြစ်သည့်အမိန့် ဖြစ်ပါသည်။

အဓိပ္ပါယ်က — USCIS သည် လူတစ်ဦး၏ နိုင်ငံသားဖြစ်မှု အမှုကို မဆုံးဖြတ်ဘဲ ရပ်ထားလို့မရပါ။ အမှုတစ်ခုချင်းစီကို ဥပဒေအတိုင်း ပြန်လည်စစ်ဆေးဆုံးဖြတ်ရမည် ဖြစ်ပါသည်။

💢 USCIS case သည် “security review,” “additional review,” “hold,” “pause” စသည့်အကြောင်းများကြောင့် မရွေ့ဘဲကြာနေသူများဖြစ်လို့မဖြစ်မနေမိမိအမှုအခြေအနေကို ပြန်စစ်သင့်ပါသည်။

🔥ချက်ခြင်းလက်တွေ့လုပ်ရန်

✅ ၁။ USCIS online account နှင့် case status ကိုစစ်ပါ။
✅ ၂။ USCIS ထံမှ ရရှိထားသော notice, email, case status screenshot အားလုံး သိမ်းထားပါ။
✅ ၃။ EAD သက်တမ်းကုန်တော့မည်ဆိုပါက renewal receipt နှင့် automatic extension ရှိ/မရှိ စစ်ပါ။
✅ ၄။ Case ကြာနေပါက attorney သို့မဟုတ် accredited representative နှင့် service request, congressional inquiry, ombudsman request, mandamus option စသည်တို့ကို ဆွေးနွေးပါ။
✅ ၅။ “ဒီ ruling ထွက်လို့ case သေချာအောင်မယ်” ဆိုသော မမှန်သောမျော်လင့်ချက်များကို မယုံကြပါနှင့်။

💢မေတ္တာ၏ သတိပေးချက်
ဒီသတင်းက ဝမ်းသာစရာတစ်ခု ပေမယ့် အောင်ပွဲကြီးမရသေးပါ။
တရားရုံးက USCIS ကို အမှုများအား “ဥပဒေအတိုင်း ပြန်လည်စစ်ဆေးဆုံးဖြတ်ရန် “ပြောလိုက်ခြင်း သာဖြစ်သလို Travel Ban ကို ဖျက်သိမ်းလိုက်ခြင်း လည်းမဟုတ်ပါ။
Visa အသစ်ထုတ်ပေးခြင်း၊ အမေရိကန်ပြင်ပမှ ဝင်ရောက်ခွင့်ကိစ္စများသည် သီးခြားစည်းကမ်းများအရ ဆက်လက်
သက်ရောက်နိုင်ဘို့”အနာဂါတ်အိမ်မက်ရှိသူ”တွေပြင်ဆင်ထားကြဖို့တပ်လှန့်လိုက်တာပါ။

✅case pending အားလုံး မိမိ case document များကို “စနစ်တကျစုပါ”“qualified immigration attorney သို့မဟုတ် DOJ accredited representative နှင့် တိုင်ပင်ပါ။

❤️‍🩹မေတ္တာ၏ ရပ်တည်ချက်ကရှင်းပါတယ်။ကြောက်အောင်မလှည့်စားဘူး။မှန်တဲ့မျှော်လင့်ချက်တွေလမ်းညွှန်မယ်။ မမှားအောင်တဲ့မယ်။ခုလုပ်စရာမှန်သမျှခုထလုပ်ဘဲ။
