Sorry folks, I stopped posting about our fight with Dearborn County Health Department once it turned into a stalemate. Just a few things happened (mostly good for us) but I believe my case should be closed due to the fact my back yard septic field has been dry since the lines were cleaned, and only my Son and I are living in the house, versus five people.

For those wanting to know what happen, and what we learned about septic issues with Dearborn County Health Department, you can stop by and chat if you see me, or give me, Walt Plageman a call 812-584-6293. Otherwise, I'm on to better things in my life.

Should the Health Department decide to continue their antagonistic behavior, I do have a few more moves I could make - but I'll keep those to myself for now.

Another reversal, the DCRSD Board has changed it's mind. They will not assist in the main sewer line extension. Apparently, the only recourse is to get LMH Sewer Utility to finish what they started by using funds from just a few households that need or wish to have service, then ask those same few households to cough up the 'Tap-In' fees for their individual homes. While all the in-between residences get a free bonus improvement to their properties due to having the sewer service availability afforded to them at no cost. This is insane!

Please, can anyone offer up a logical justification for such a scenario?

The Dearborn County Health Department responded to the Indiana State Public Access Counselor's office as if they were always open to my access to the records that I am seeking. This is a total 180 from the statements made publicly by their administration, agents and their own attorney.

On Oct. 23rd I emailed a request for records from the Health Department to expose their oversight of failing septic systems in our area. Attached was what I received on Oct 26th stating my request went to their attorney's attention and they would not surrender those records without his counsel.

Next document reflects the Heath Department claim that no such request was received, when it was indeed.

The next document is the response from the Indiana State Public Access Counselor stating that the Dearborn Health Department is required to inform me of their denial within 24 hours in spite of the fact I did not use their request form.

Upcoming County Board Request from the SDRSD of about
$65,000 to complete the Main Sewer Line down Blue Ridge Dr. There will be a bid process to invite three or more contractors, but I trust it will be expedited.

I requested help from the Indiana State Public Access Counselor's Office, to expose the Health Department Records on the state of complaints and failures with other Dearborn County Onsite Septic Systems. This will hopefully push for more proactive policy standards to protect individual homeowners solely targeted as offenders without reasonable solution to remedy. Especially when that individual homeowner is surrounded by equally failing systems.

Still asking for help from anyone that can help us with a potential legal action to correct our dysfunctional Health Department. Communication requirements and standards need to be vastly improved between county agencies and the public they serve.

Finally, The Sewer Board voted last night to proceed with the 'Blue Ridge Drive' project. About five households responded favorable to tap-in. Hope they get started quickly!

We were told that 'Jack-Booted Thugs' would not be evicting us from our home on the deadline of December 15th, but they go ahead and get a judgement to do just that. Forced 'Dump & Pump' is the only way to stay in our home after the deadline. Anyone have an extra $500 for this bi-monthly service? I don't.

My Wife called. Said she just received notice that we are to vacate in 60 days. Know more tomorrow when I visit the Health Department. I have not countered with any legal action in hopes the Health Department would wait for the results of the bingo card responses. Now I need help, can anyone help us?

SDSD board meeting update: From what I am told, the board voted last night to limit the mail questionnaire to just Blue Ridge Dr. residents because of my pending civil action. I don't know if others living without access to a main line will have the same offer of SDSD financing and 'Tap In' fee waived - you might need to ask them. Should see the questionnaire in the mail within 2 weeks.

Health Department apparently has just changed their mind in regards to allowing me to only have the right to complain about my neighbors septic failure. I have been informed they will now allow me to summit a complaint against any Dearborn resident as long as it is not frivolous.

Not out to force anyone to 'Tap In' if they have a working septic, but I will be out to disclose those property owners who have been hiding their failed septic. Don't blame me - they won't do their job,

I can't make the next meeting scheduled for this coming Thursday 9/17. Would love to hear if anyone would be interested in going to this meeting. Anticipated topics: Engineering/Survey issues and estimated cost for hook up to be determined for Bingo card mailing.

This morning a Dearborn County Police Officer at our door carrying a no trespass sign, that we placed on our property to protect our complaining neighbor from being exposed to a potential health hazard source of our septic field.

To keep our officers out fighting crime instead of babysitting a complaining neighbor who will call the police over our civil situation, we relented and told the officer we will wait for the county survey to be completed. He was grateful that we not press the issue. GEEEEZZZEEE!

If anyone has a ideas that could help us, we are all ears!
