HB 5211 has cleared the Michigan House Judiciary Committee. This is a significant step forward for the legislation, but it has not yet become law.

▪️What House Bill 5211 Would Do

House Bill 5211 would amend Michigan's child custody law by adding equal or approximately equal parenting time with both parents as a factor in determining a child's best interests. The bill is part of a package with HB 5212 and HB 5213 aimed at expanding shared parenting considerations in custody cases.

Supporters argue the legislation would create a stronger presumption that children benefit from meaningful relationships with both parents when both are fit and willing to parent. The proposal would still allow courts to deviate from equal parenting time when evidence shows it would not be in the child's best interests.
