🚨 ACTION ALERT: Louisiana HB 1107 🚨
This bill will be heard in Administration of Criminal Justice Thursday, April 23rd at 10:00 a.m.
HB 1107 by Representative Melerine, changes how Intellectual Disability (ID) is defined in death penalty cases, but it does not follow established medical standards or legal guidance and could lead to people being misclassified.
Getting Intellectual Disability (ID) determinations right is critical. Experts and the U.S. Supreme Court say these decisions must follow current medical standards and account for the complexity of diagnosis.
HB 1107 would:
• REPLACE CLINICAL JUDGMENT WITH LEGISLATIVE CRITERIA
• OVEREMPHASIZE IQ OVER ADAPTIVE FUNCTIONING
• IGNORE THE STANDARD ERROR OF MEASUREMENT (SEM)
No matter where you stand on the death penalty, fairness and accuracy in the justice system should be a shared priority.

• Align it with clinical standards (AAIDD, DSM-5)
• Preserve the courts flexibility
• Avoid rigid IQ cutoffs already rejected by the courts
