Never a dull moment over here at Just-us Participatory Defense but this week we had a case referred to us from another agency that was for the books.

We had a family reach out to us because they discovery two days before their loved one was to sign a plea for a substantial amount of time. They had been conned into paying a non licensed “investigator” thousandssssss of dollars to represent their loved one in 4 F1s as their attorney. The “investigator” told the family he would have to employ a “second chair”. The “investigator” did pay a licensed attorney less then half of what the family paid the “investigator” a little less than a year after the “investigator” had already been “representing” the D. The licensed attorney accepted the monies from the “investigator” with out ever consulting with the D or the family.

Thankfully, with a lot of fancy footwork with multiple agencies we were able to get this information to the courts so that this D would have an opportunity at a fair defense and not signing his life away today.

Supreme Court Emergency Eviction Order.

While the CARES Act and the TX Supreme Court's 20th emergency order provide protections for tenants, landlords may try other methods to make a tenant leave. Tenants should know that they never have to leave their rental property until the judge rules against them in court and the Writ of Possession says they must leave. Other methods include locking tenants out of their homes or illegally shutting off their water, lights, or gas. Lone Star Legal Aid’s Housing advocates put together answers to common questions related to renter’s rights in these situations.
