AHVA UPDATE: Back to Montgomery

Today, AHVA advocates are heading back to Montgomery to continue pushing for a fair and sensible v***r tax.

Right now, Alabama’s current law set to take effect in October 2026 taxes v***r products at 10 cents per mL. That means the more liquid a product contains, the more tax a consumer pays — regardless of ni****ne level.

That hurts lower-ni****ne adult users the most, while creating incentives for consumers to move toward higher-strength or more harmful products instead.

AHVA advocates have been working directly with the bill sponsor and the Department of Revenue to explain the real-world impact of this tax and push for a better solution, but time is running out this session.

We need your voice NOW.
Please contact your State Representative and Senator and urge them to fix the v***r tax before time runs out.

🚨🔥 ALABAMA V***R TAX ALERT – LAST CHANCE TO FIX THIS 🔥🚨

Today, our advocates are traveling to the Alabama State House to continue working toward a fix to the v***r tax before it takes effect.

📅 October 1 is coming fast.
⏳ And the legislative session is quickly coming to a close.

Once session adjourns, there will be no opportunity to adjust this policy before the tax goes into effect. The window to correct it is now.

Beginning October 1, Alabama will enforce a $0.10 PER MILLILITER excise tax on v***r products — on top of existing state and local sales taxes.

⚠️ In cities that passed local v**e taxes early, consumers will soon face DOUBLE taxation.

Here’s what lawmakers must understand:

💧 The tax is based on liquid volume — NOT ni****ne strength.
⬇️ Adults using lower ni****ne levels often purchase larger bottles — meaning they will pay the highest effective tax rates.
🚬 Alabama ci******es carry a $0.675 per pack state tax, yet moderate v***r consumers could pay significantly more under this structure.
📉 In a tough economy, this tax may push adults toward higher ni****ne concentrations to offset costs — or back to combustible ci******es.

This affects:
✔ Adult harm-reduction consumers
✔ Fixed-income residents
✔ Responsible Alabama small businesses
✔ Cities now facing stacked local + state taxes

📢 TAKE ACTION TODAY

Find your State Representative and Senator here:

Call. Email. Be respectful — but be clear.
Ask them to support a fix before session ends.

🗣️ October 1 is approaching.
🗓️ The clock on session is ticking.
Now is the time.

AHVA UPDATE: We’re at the Alabama State House Today

Today, advocates with the Alabama H**p and V**e Association (AHVA) are traveling to the Alabama State House to meet directly with legislators.

We are fighting for small businesses and adult consumers across this state.

🚨 Starting in October, Alabama’s new v***r tax will impose a $0.10 per milliliter tax on v***r products.

That means:

• 30mL bottle = $3.00 tax
• 60mL bottle = $6.00 tax
• 100mL bottle = $10.00 tax

This is a volume-based tax — NOT a ni****ne-based tax.

It punishes lower ni****ne users the most, because the lower the ni****ne level, the more liquid a consumer must purchase to meet their needs.

Consumers who intentionally stepped down their ni****ne levels to reduce dependence will now pay the highest tax.

⚠️ It gets worse.

Several Alabama cities implemented this tax early at the local level.

When the statewide tax goes into effect in October, those cities will be hit with a DOUBLE tax — meaning consumers and small businesses in those communities will pay both the municipal tax AND the new state tax.

That creates:

• Higher prices in certain cities
• Uneven competition across the state
• A heavier burden on local consumers
• More pressure on small businesses already operating on thin margins

This impacts:

• Adults using v***r products as an alternative to smoking
• Fixed-income consumers
• Small, locally owned businesses
• Alabama jobs and storefronts

For many retailers, this tax could be devastating. It creates a pricing structure that pushes consumers to:

• Purchase out-of-state
• Buy online
• Seek unregulated products
• Or return to combustible ci******es

That’s not public health — that’s bad policy.

📣 WE NEED YOU

If this tax impacts you, your family, or your business — NOW is the time to speak up.

👉 Find your Alabama Representative here:
https://www.legislature.state.al.us/house-of-representatives-members

👉 Find your Alabama Senator here:
https://www.legislature.state.al.us/senate-members

Call. Email. Show up.

Tell them:

• How this tax will affect you personally
• How it will affect your budget
• How it will affect your business
• Why a volume-based tax structure is flawed
• Why double taxation in certain cities is unfair

Legislators need to hear directly from the people they represent.

We are working at the State House — but your voice at home matters just as much.

Advocacy works when everyone participates.

🚨 ALABAMA: THEY WANT TO BAN H**P PRODUCTS ALREADY 🚨

A new bill filed in the Alabama Senate — SB321 — would ban h**p-derived cannabinoid products across Alabama.

And here’s the part that should concern everyone:

⚠️ This ban is being proposed BEFORE businesses and cities have even had time to fully navigate the law that was just put into place.

Businesses across the state have spent months trying to:

• Understand the new regulations
• Apply for licenses
• Comply with state rules
• Work with cities on zoning and approvals

Now SB321 proposes to eliminate the entire system before it has even had time to work.

If passed, this bill would:

❌ Ban h**p-derived cannabinoids
❌ Shut down compliant small businesses
❌ Criminalize products adults are currently allowed to purchase legally

This would move Alabama from regulated sales → straight to prohibition.

⚠️ But the bill is not law yet.

Right now it is sitting in the Senate Healthcare Committee, and the committee leadership will decide whether it moves forward.

📢 THIS IS THE MOMENT TO SPEAK UP

Consumers, employees, and small business owners need to respectfully contact the committee leadership and ask them to OPPOSE SB321.

“My name is ___ and I’m an Alabama resident. I respectfully ask you to oppose SB321. Businesses and cities across Alabama are still trying to navigate the new h**p regulations that were just put into place. Banning these products now would shut down compliant businesses and criminalize products adults currently purchase legally. Please support responsible regulation instead of prohibition.”

⏱ It takes less than 2 minutes to speak up.

Small businesses, employees, and consumers across Alabama are depending on it.

📢 Please share this so more Alabamians know what is happening.

🚨 AHVA MEMBERS — TAKE ACTION TODAY 🚨

Today, our team is traveling to Montgomery to continue critical conversations on v**e and h**p regulation reform to protect small businesses and preserve consumer choice. We need your voice reinforcing those discussions right now.

👉 Please contact your House and Senate representatives TODAY and share:
• How current regulations have impacted your small business or access to products you rely on
• Why the upcoming v**e tax (or existing local tax) will be the final regulatory burden forcing more Alabama businesses to close
• That Alabama still has little to no access to h**p products due to licensing red tape and a broken licensing structure requiring businesses to completely change their models just to stay compliant
