Glenda Yarbrough’s husband Ron was killed by medical negligence. A death that never should have happened. Glenda fought for accountability all the way to a jury trial.

She trusted 12 community members to listen to the evidence. They did. They decided a number that would hold those responsible for Ron’s death accountable.

Medical malpractice is the 3rd leading cause of death. And now healthcare corporations are pushing for a $350k cap on medical malpractice wrongful death cases. Even if a jury listens to all the facts and comes to a unanimous decision, the law can override them and put a price tag on your loved one’s life.

Why even have a jury trial if the law says the outcome is already decided?

A cap of $350,000 will never measure the hole left in a family after a child is taken from them.

Shannon McGuffie was 20 weeks pregnant with her daughter, Halo Skye, when she was told everything was fine. It wasn’t. Sadly, Halo did not survive. Her death was preventable.

“We are forever broken. We are forever damaged,” Shannon said.

That’s what damage caps do. They turn real loss and pain into an arbitrary, one-size-fits-all number.

A cap doesn’t make harm smaller. It just makes responsibility cheaper.

Families deserve accountability. Communities deserve safety. And human lives should never be treated like a budget line item.

Families from across Georgia will gather at the Georgia Supreme Court Tuesday afternoon to speak against applying an arbitrary limit or cap on what can be awarded in cases where people are injured or killed due to medical negligence and to advocate for the long-standing right to have juries determine damages.

The Georgia Supreme Court will hear oral arguments at approximately 11:20 a.m. in two closely watched cases that could determine whether lawmakers may impose a $350,000 cap on damages for medical malpractice, including wrongful death cases.

Following the hearing, Voices of Families for Justice will hold a press conference at 1:00 p.m. on the steps of the Georgia Supreme Court, featuring families who have suffered devastating losses from medical malpractice. These are families whose lives were irreparably changed by a negligent healthcare system.

A $350,000 damage cap will protect healthcare corporations for negligently killing or severely harming people, especially the most vulnerable. These caps would allow for billion-dollar medical and insurance companies to easily budget for negligent deaths and injuries as a cost of doing business, increasing risk for all patients across the system.

Voices of Families for Justice talked to Blake on the Beltline. He and his dad both have diabetes, and they rely on insurance to afford the insulin that keeps them alive.

But insurance hasn’t felt like protection. Blake shared that his health insurance company is greedy and raise his rates every year.

He said people should be able to keep insurance companies in check when it comes to pricing. Life-saving care shouldn’t depend on profit margins.

This week, Voices of Families for Justice brought real people’s stories directly to the places where decisions are made.
We talked with people on the Beltline about their lived experiences.

We stood alongside Healthy Mothers, Healthy Babies at the Capitol for Maternal Health Awareness.

And we supported a family who lost their child because of preventable medical errors as they spoke directly to lawmakers about what happened and how we can keep other families from going through the same loss.

Change happens when people share their stories and demand transparency, accountability, and access to civil justice. Every voice matters.

37.9 deaths per 100,000 live births, and 87% of those deaths were preventable.

That’s not just a statistic. Those are mothers who should still be here.

Maternal health is tied directly to infant injury and infant deaths. When mothers aren’t protected, babies aren’t either.

Preventable harm and deaths mean the system failed and families deserve accountability when that happens.

On January 21, Voices of Families for Justice will be at the Capitol advocating for maternal health awareness and standing with families who deserve better.

You didn’t ask to be hurt. You didn’t cause what happened. But once someone else’s negligence changes your life, the fight begins.

You end up battling a billion-dollar insurance company you’re not even allowed to name in court.

They stay hidden while spending premium dollars on lawyers, experts, and delay. They lobbied the legislature to change the rules.

Now they get to tell a jury your pain is worth less because your health insurance covered part of the bill. Insurance you paid for, month after month.

So while you are left alone to rebuild your life as best you can, the insurance companies are making money and lobbying for laws to protect their profits.

That comes from a CBS News analysis of 2024 Medicare and Medicaid data, reviewing more than a billion claims.

That number represents real people.Families waiting on care. Patients fighting paperwork while fighting to get better.

And the truth is, we still don’t even know how bad the problem really is.

How often do insurance companies refuse to cover medical treatment?

It’s hard to say because insurers are only required to report denial data for plans bought through healthcare.gov. Most people with employer-based insurance never see those numbers at all.

What we do know is this:
Insurance companies make money when care is delayed or denied. That’s why real insurance reform matters.

No family should have to fight an insurance company just to follow their doctor’s advice, and no one should have to choose between giving up and going broke.

People deserve care, and communities deserve a system that puts health and dignity before profits.
