To the Forest Park III community;

My name is Deidre Schultz and I have been a non-officer member of the board for two years. I have never been involved in the day-to-day management of the Board, I help out with special projects and occassionally filling in for the bookkeeper. I have one more year that I could serve on the board, however, I am planning to turn in my resignation at the annual meeting. As Kyle is also done serving after the annual meeting, there are currently ZERO board members as of December 1. Because we just learned about the new state regulations less than a month ago and three Board members have resigned, we have been working to find as much information so you know what our options are moving forward. We are not professional property managers. We are concerned property owners trying to keep things moving. All the suggestions and questions you have require many hours of manpower that we do not have. Kyle and I are both parents of school age children with full-time jobs. All of the information posted in the agenda and on Facebook is to help you understand the options and costs involved. These are all estimates and none of these things have been pursued or completed. The information posted on Facebook is to help you understand the dire situation that we are in. I personally do not see a path forward without assessment fees increasing, and I certainly cannot manage developing a website and doing the bookkeeping and talking to lawyers and answering everyone's complaints FOR FREE. Can any of you do any of those things? If so, PLEASE VOLUNTEER IMMEDIATELY. I am willing to help with a transition to more capable hands. The annual meeting must be held in November hence the last day of the month. We had to talk to a lawyer before sending out the meeting notice. It is what it is folks. We need three people to step up and help decide how to move forward with the budget for next year and the management of the Board.

Regarding Receivership: The cost of a state receivership over an HOA in Florida can be substantial, and can have a negative impact on the community:
* Receiver's salary�The receiver is entitled to a salary and reimbursement of costs and attorneys' fees. Receivers are often lawyers who bill by the hour, and can charge over $200 per hour.
* Court costs�The association is responsible for court costs associated with the receivership.
* Attorney fees�The association is responsible for attorneys' fees associated with the receivership.
* Increased dues�The cost of the receivership is usually passed on to the owners in the form of increased dues or special assessments.
* Other expenses�The receiver's salary, court costs, and attorney fees are added to the common expenses, which increases the assessments for all owners.
* Other consequences of a receivership include:
* Potential homebuyers and lenders may be scared off.
* Property values in the community may decrease.
* The HOA may lose its insurance coverage.
* Common area maintenance may decline.
* All HOA members may be exposed to civil action.
* A receiver is usually appointed by the court when no members of the association are willing to serve on the board.

Regarding Levy County and road maintenance. We spoke at length to Levy County Road Works. They explained it thus: because our roadways are legally deeded to the Forest Park III we would have to get 100% owner sign off and 100% mortgage companies to sign off on all deeds being transferred to Levy county. This process would include presenting our case to the Levy County Board of commissioners who would have to vote to agree to accept our roads. At the expense of FP3 we would need to have all roads surveyed and all titles to properties searched (and in event of deaths and sales, likely multiple times.) The process takes a minimum of four years. The county would also have to rewrite the tax rates for all 265 properties. If we were successful in this, and the county accepted our deeds, then we would become basically at Will for road maintenance. Because our roads are not public through ways (like University Oaks,) we would not be put on a regular maintenance schedule. They would only address our roads when in our area, and in emergency situations. They strongly discouraged us from pursuing this route due to the time, cost, hassle, and all to not receive a good service in the end.

Yes, we are a legally registered association with the State of Florida. The original filing date was September 19, 1971 and was reinstated in 1991. We have been filing annual reports with the State of Florida since, and as far as they are concerned at Sunbiz (the State) we are legal. If anyone would like to mail in a request to the state with a check for $8.75, they will send us a copy of our original incorporation documents. Prior to 1995 everything was kept on micro film. Anyone can go to the sunbiz website to see our current standing.

Attention Homeowners & Residents of Forest Park III POA:
On Saturday, November 30th, 2024 we will be holding our annual Budget Meeting followed by our Annual General Meeting at 10 am at the Wilson Robinson Park in Archer @ 13975 SW 174th Street, FL 32618.

We just learned a few weeks ago about the new state regulations regarding the governance of Florida HOA/POA's. There are legal and logistical ramifications and you are receiving this as we are scrambling to contact lawyers and gather information for you all to make informed decisions.

We have several major decisions to make as a community regarding the future of Forest Park III & which are outlined in the attached materials.

Most importantly, we need 1 person to volunteer before our board meeting to assist with the budget & vote on it during the Annual Budget Meeting.
We will need 3 more board members to volunteer during our Annual General Meeting to lead Forest Park III POA through 2025 and beyond.

AS OF RIGHT NOW, WE WILL NOT HAVE ENOUGH BOARD MEMBERS TO PROPERLY FUNCTION. In turn, the residents of FP3 will be responsible for funding a "receiver" from the county or state to manage the association until we find the appropriate board members.

We will be sending out emails providing these documents to everyone.

My name is Kyle Hobbs, and I am the interim “President” of the Forrest Park III Property Owner Association. Last week, there was some obvious confusion between board members as we had 2 board members resigning and were turning in their binders and other miscellaneous items owned by FP3. I did not request a formal meeting, nor did I know that one was posted to the page (that I still do not have access to). I would never have agreed to having a meeting on Halloween either, especially since I have young children and it is a very special day to families.
This meetup, never warranted an official meeting. I wanted to simply collect their stuff and get back to work and agreed to meet up with Ed and Tracy on 10/30/24. Here are the notes.
• Collected binder from Ed & Tracy due to their resignation as of 8/31/2024.
• Since Carla was there, I told her to deliver Tracy the check for the tree service contractor since it hasn’t been done yet and the contract is Net30 and nearing the term.
• Informed other board members we have had 4 companies turn down their services to FP3 due to reputation and/or past experiences. This includes the company that has been repaving the roads on Archer Rd.
o No responses from Angie’s list postings except from paving companies.
• Mentioned to the others the need to find all new board members who are willing to set the foundational groundwork for the new standards coming 2025.
• Left. Less than 45 minutes total which was 35 more than I anticipated.
No meeting was ever called to order, nor anything voted on. At the time, I wasn’t even aware of any Facebook postings since I don’t have access to it still.
I have already turned in my resignation prior to this meetup for similar reasons as the other 2 previous board members, but I have to wait until a new member is found who will take on the role as president. I never even intended to even be the President in the first place, but that is a whole other discussion.
