Since 2006, the nonprofit Pregnancy Justice has documented 1600+ cases where people were charged with pregnancy-related crimes. The organization has just issued a report tracking 412 cases in the first two years after the Supreme Court reversed Roe v. Wade in 2022. The cases are primarily in Southern states where low-income women in particular have been charged with crimes ranging from child abuse, endangerment, neglect, and even homicide. Because there is no database tracking pregnancy-related prosecutions, Pregnancy Justice believes this is an undercount.

Nearly all of the cases tracked during the two years involved alleged substance abuse. In many cases, the medications were prescribed by a medical practitioner. Prosecutors rarely needed to provide proof that the fetus had been harmed. RFK's scientifically unsupported claim that acetaminophen use during pregnancy is linked to autism is causing alarm bells to ring in parts of the country where women have been convicted for using medications recommended by their doctors. The organization has also tracked cases where miscarriage or stillbirth resulted in criminal charges.

As some states move to develop legal definitions of "fetal personhood," we could soon be hearing of homicide charges against women who seek abortions. In some of those states, homicide is a capital crime.
